Stat. tit. 15, § 15-141.5","heading":"Requirements for licensure","body":"The Insurance Commissioner shall not issue or renew a license to\n\nany service warranty association unless the association:\n\n1. Is a solvent association;\n\n2. Furnishes the Insurance Department with satisfactory\n\nevidence that the management of the association is competent and\n\ntrustworthy and can successfully manage the affairs of the\n\nassociation in compliance with law;\n\n3. Proposes to use and uses in its business a name together\n\nwith a trademark or emblem, if any, which is distinctive and not so\n\nsimilar to the name or trademark of any other person already doing\n\nbusiness in this state as will tend to mislead or confuse the\n\npublic;\n\n4. Files the bond required by the Service Warranty Act;\n\n5. Is formed under the laws of this state or another state,\n\ndistrict, territory, or possession of the United States, if the\n\nassociation is other than a natural person; and\n\n6.
