For purposes of this section, “construction agreement” means\n\na contract, subcontract, or agreement for construction, alteration,\n\nrenovation, repair, or maintenance of any building, building site,\n\nstructure, highway, street, highway bridge, viaduct, water or sewer\n\nsystem, or other works dealing with construction, or for any moving,\n\ndemolition, excavation, materials, or labor connected with such\n\nconstruction.\n\nB. Except as provided in subsection C or D of this section, any\n\nprovision in a construction agreement that requires an entity or\n\nthat entity’s surety or insurer to indemnify, insure, defend or hold\n\nharmless another entity against liability for damage arising out of\n\ndeath or bodily injury to persons, or damage to property, which\n\narises out of the negligence or fault of the indemnitee, its agents,\n\nrepresentatives, subcontractors, or suppliers, is void and\n\nunenforceable as against public policy.\n\nC. The provisions of this section do not affect any provision\n\nin a construction agreement that requires an entity or that entity’s\n\nsurety or insurer to indemnify another entity against liability for\n\ndamage arising out of death or bodily injury to persons, or damage\n\nto property, but such indemnification shall not exceed any amounts\n\nthat are greater than that represented by the degree or percentage\n\nof negligence or fault attributable to the indemnitor, its agents,\n\nrepresentatives, subcontractors, or suppliers.\n\nD. This section shall not apply to construction bonds nor to\n\ncontract clauses which require an entity to purchase a project-\n\nspecific insurance policy, including owners’ and contractors’\n\nprotective liability insurance, project management protective\n\nliability insurance, or builder’s risk insurance.\n\nE. Any provision, covenant, clause or understanding in a\n\nconstruction agreement that conflicts with the provisions and intent\n\nof this section or attempts to circumvent this section by making the\n\nagreement subject to the laws of another state, or that requires any\n\nlitigation, arbitration or other dispute resolution proceeding\n\narising from the agreement to be conducted in another state, is void\n\nand unenforceable.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bfa5b26c5bca9780de9ef24f590689cf1f8ccbbbb3676be0cb9a276dbdc6256b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-220","next":"us-ok/okla.-stat.-tit.-15-15-221a"},"notice":"GroundRules: Original legal text.
