Stat. tit. 15, § 15-235","heading":"Duty of party attempting rescission","body":"Rescission, when not effected by consent, can be accomplished\n\nonly by the use, on the part of the party rescinding, of reasonable\n\ndiligence to comply with the following rules:\n\n1. He must rescind promptly, upon discovering the facts which\n\nentitle him to rescind, if he is free from duress, menace, undue\n\ninfluence, or disability, and is aware of his right to rescind; and,\n\n2.
