Stat. tit. 15, § 15-325","heading":"When promise deemed original","body":"A promise to answer for the obligation of another, in any of the\n\nfollowing cases, is deemed an original obligation of the promisor,\n\nand need not be in writing:\n\n1. Where the promise is made by one who has received property\n\nof another upon an undertaking to apply it pursuant to such promise;\n\nor by one who has received a discharge from an obligation in whole\n\nor in part, in consideration of such promise.\n\n2. Where the creditor parts with value, or enters into an\n\nobligation, in consideration of the obligation in respect to which\n\nthe promise is made, in terms or under circumstances such as to\n\nrender the party making the promise the principal debtor, and the\n\nperson in whose behalf it is made his surety.\n\n3. Where the promise, being for an antecedent obligation of\n\nanother, is made upon the consideration that the party receiving it\n\ncancels the antecedent obligation, accepting the new promise as a\n\nsubstitute therefor; or upon the consideration that the party\n\nreceiving it releases the property of another from a levy or his\n\nperson from imprisonment under an execution on a judgment obtained\n\nupon the antecedent obligation; or upon a consideration beneficial\n\nto the promisor, whether moving from either party to the antecedent\n\nobligation, or from another person.\n\n4. Where a factor undertakes, for a commission, to sell\n\nmerchandise and guaranty the sale.\n\n5.
