Stat. tit. 15, § 15-58","heading":"Actual fraud defined","body":"Actual fraud, within the meaning of this chapter, consists in\n\nany of the following acts, committed by a party to the contract, or\n\nwith his connivance, with intent to deceive another party thereto,\n\nor to induce him to enter into the contract:\n\n1. The suggestion, as a fact, of that which is not true, by one\n\nwho does not believe it to be true.\n\n2. The positive assertion in a manner not warranted by the\n\ninformation of the person making it, of that which is not true,\n\nthough he believe it to be true.\n\n3. The suppression of that which is true, by one having\n\nknowledge or belief of the fact.\n\n4. A promise made without any intention of performing it; or,\n\n5.
