Stat. tit. 15, § 15-598.5","heading":"Injunctive relief - Damages - Prima facie evidence","body":"(a) In addition to the penalties provided in the Unfair Sales\n\nAct, any person injured by any violation, or who shall suffer injury\n\nfrom any threatened violation of the Unfair Sales Act, may maintain\n\nan action in any court of equitable jurisdiction to prevent,\n\nrestrain or enjoin such violation or threatened violation. If in\n\nsuch action a violation or threatened violation of the Unfair Sales\n\nAct shall be established, the court shall enjoin and restrain or\n\notherwise prohibit, such violation or threatened violation and, in\n\naddition thereto, shall assess in favor of the plaintiff and against\n\nthe defendant the cost of suit. In such action if damages are\n\nalleged and proved, the plaintiff in the action, in addition to such\n\ninjunctive relief and costs of suit, shall be entitled to recover\n\nfrom the defendant the actual damages sustained by him or her.\n\n(b) In the event no injunctive relief is sought or required,\n\nany person injured by a violation of the Unfair Sales Act may\n\nmaintain an action for damages alone in any court of general\n\njurisdiction, and the measure of damages in such action shall be the\n\nsame as prescribed in subsection (a) of this section. Provided the\n\nUnfair Sales Act shall not authorize suits or actions against\n\nnewspapers, radio broadcasters, or other advertising agencies\n\nthrough which such advertisements are published, broadcast or\n\notherwise made.\n\n(c) Evidence of advertisement, offering to sell, or sale of\n\nmerchandise by any retailer or wholesaler at less than cost to such\n\nretailer or wholesaler, shall be prima facie evidence of intent to\n\ninjure competitors and to destroy or substantially lessen\n\ncompetition.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"005816dff3afd21b2e16497ec3ac309966171b766473289d36942eda6512c97a","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-598.4","next":"us-ok/okla.-stat.-tit.-15-15-598.6"},"notice":"GroundRules: Original legal text.
