Stat. tit. 15, § 15-598.6","heading":"Exempted sales","body":"The provisions of the Unfair Sales Act shall not apply to the\n\nfollowing sales at retail or sales at wholesale:\n\n1. Where seasonable merchandise is sold in bona fide clearance\n\nsales, if advertised, marked, and sold as such;\n\n2. Where perishable merchandise must be sold promptly in order\n\nto forestall loss;\n\n3. Where merchandise is imperfect or damaged or is being\n\ndiscontinued and is advertised, marked and sold as such;\n\n4. Where merchandise is sold upon the final liquidation of any\n\nbusiness;\n\n5. Where merchandise is sold for charitable purposes or to\n\nrelief agencies;\n\n6. Where merchandise is sold on contract to departments of the\n\ngovernment or governmental institutions;\n\n7. Where merchandise is sold by any officer acting under the\n\norder or direction of any court;\n\n8. Where merchandise is sold at any bona fide auction sale; and\n\n9. Where a particular item of merchandise corresponding to a\n\nunique identifier is sold at below cost for fifteen (15) or fewer\n\nsequential days and where such single-day or multi-day sale does not\n\noccur more than ten (10) separate times in any twelve-month period.\n\nThis exemption shall not apply to:\n\na. gasoline and diesel fuel,\n\nb. legend drug products,\n\nc. food and nonalcoholic beverages sold for off-premise\n\nuse or consumption,\n\nd. household soaps and detergents,\n\ne. health and beauty aids,\n\nf. over-the-counter medicines, vitamins, and health\n\nproducts, excluding exercise equipment and durable\n\nmedical products,\n\ng. pet food and pet supplies,\n\nh. paper and plastic goods,\n\ni. household cleaning agents and cleaning supplies,\n\nj. baby supplies directly related to nutrition and food\n\npreservation, consumption and disposal, including\n\ndisposable diapers,\n\nk. low-point beer, as defined in paragraph 1 of Section\n\n163.2 of Title 37 of the Oklahoma Statutes, sold for\n\noff-premise use or consumption, and\n\nl. structural building materials, including but not\n\nlimited to lumber and lumber composites, engineered\n\nwood products, structural wood panels, roofing,\n\nguttering, siding, drywall, insulation, flooring,\n\nwindows, doors and plumbing elements.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1410fd911132271a03f462939e4299346871853b32b21e81098802fd22973a50","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-598.5","next":"us-ok/okla.-stat.-tit.-15-15-598.7"},"notice":"GroundRules: Original legal text.
