Stat. tit. 15, § 15-653","heading":"Purchase or sale other than in regular course of trade or","body":"business - Sales to employees.\n\nNo person in this state shall, by any method or procedure,\n\ndirectly or indirectly, by itself or through any subsidiary agency\n\nowned or controlled in whole or in part by such person, purchase, or\n\nexhibit catalogs for the purchase of, any articles, material,\n\nproduct or merchandise of whatever nature in the name of or on the\n\ncredit of such person, or at special discounts available to such\n\nperson, for any other purpose than for use or resale in the regular\n\ncourse of business of such person, or sell, cause to be sold,\n\nprocure for sale or have in its possession or under its control for\n\nsale to its employees any article, material, product or merchandise\n\nof whatever nature not of its own production or not handled in its\n\nregular course of trade or business; provided that nothing in this\n\nact is intended or shall be construed as prohibiting the giving of\n\nany such article, material, product or merchandise as an incentive,\n\naward or gift; provided further, that this section shall not apply\n\nto purchases by a person for the purpose of resale or gratuity to\n\nits employees of tools, products and paraphernalia which are\n\nconsumed, used or worn by employees in the performance of such\n\nemployees' regular duties in such trade or business and are\n\nbeneficial to the health, safety and working conditions of such\n\nemployees.\n\nNo person shall permit the use of its name, credit, facilities,\n\nor the services of its employees, nor shall such person in any way\n\npromote or sponsor the sale, offer of sale, or assistance in\n\nnegotiating or completing a sale to its employees through such\n\nperson at wholesale prices of any such merchandise not manufactured,\n\nproduced or customarily dealt in or handled by such person in the\n\nregular course of its business; provided that nothing in this act is\n\nintended or shall be construed as prohibiting any person qualified\n\nunder the laws of Oklahoma as a public service corporation from\n\npromoting or sponsoring through established advertising media the\n\nuse and sale or equipment utilizing the product or service supplied\n\nto the public by such person, or assisting established retail\n\ndealers in the promotion of the sale and use of such equipment.\n\nProvided however that nothing contained herein shall affect those\n\nrelationships existing between the producer of crops or livestock\n\nand the person or persons supplying said producer with the means of\n\nproducing same.\n\nNo person engaged in the sale of merchandise shall misrepresent\n\nthe true nature of such business in any form of advertising by the\n\nuse of the words manufacturer, wholesaler, or retailer, or\n\notherwise, either in sales in its regular course of business or\n\nsales to its employees.\n\nNothing in this act shall ever abridge or impair the right of\n\nany person to freely contract with any other person concerning any\n\nmatter not prohibited hereby or by any other civil or criminal laws\n\nof this state; and further, nothing in this act shall prohibit any\n\nperson from enjoying the rights guaranteed by Section 2 of Article\n\nII of the Constitution; nor shall any person by this act be denied\n\nthe right to freely speak and write upon all subjects as guaranteed\n\nby Section 22, Article II of the Constitution.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ce62f2563d8f2c029d134335aea1697688f4670a4e5f1cfd412bdd6c75abfd51","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-652","next":"us-ok/okla.-stat.-tit.-15-15-654"},"notice":"GroundRules: Original legal text.
