Stat. tit. 15, § 15-755.1","heading":"Automatic dial announcing devices - Operation -","body":"Conditions.\n\nA. The connection of an automatic dial announcing device to a\n\ntelephone line is subject to the provisions of the Oklahoma Consumer\n\nProtection Act.\n\nB. No person shall operate an automatic dial announcing device\n\nexcept in accordance with the provisions of the Oklahoma Consumer\n\nProtection Act. The use of such device by any person, either\n\nindividually or acting as an officer, agent, or employee of a person\n\nor corporation operating automatic dial announcing devices, is\n\nsubject to the provisions of the Oklahoma Consumer Protection Act.\n\nC. A person shall not use an automatic dial announcing device\n\nexcept as provided by this section. An automatic dial announcing\n\ndevice shall be used only when:\n\n1. The device disconnects from the called person's line not\n\nlater than twenty (20) seconds after the called person hangs up; and\n\n2. For calls terminating in this state, the device is not used\n\nto make a call:\n\na. before 9 a.m. or after 9 p.m., or\n\nb. at any hour that collection calls would be prohibited\n\nunder the federal Fair Debt Collection Practices Act,\n\n15 U.S.C., Section 1692(c), when the device is used\n\nfor collection purposes; and\n\n3. One of the following occur:\n\na. the calls are made or messages given solely in\n\nresponse to calls initiated by the person to whom the\n\nautomatic calls or recorded messages are directed or\n\nwho has made a written request to be called,\n\nb. the calls made concern goods or services that have\n\nbeen previously ordered or purchased,\n\nc. the calls are made by creditors or their assignees, or\n\nd. the calls are initiated by a live operator who gives\n\nthe caller the option to disconnect prior to the\n\nplaying of a prerecorded or synthesized voice message.\n\nD. An automatic dial announcing device shall not be used for\n\nrandom number dialing or to dial numbers determined by successively\n\nincreasing or decreasing integers.\n\nE. A telephone company in this state may, but shall not be\n\nrequired to disconnect or refuse to connect service to a person\n\nusing or intending to use an automatic dial announcing device if the\n\ntelephone company determines that the device is not capable of\n\ndisconnecting from a called party's line as required by this section\n\nor that the device would cause or is causing network harm.\n\nF. The telephone company shall give notice to the person using\n\nthe device of its intent to disconnect service not less than three\n\n(3) days prior to the date of the disconnection, except that if the\n\ndevice is causing network congestion or blockage, the notice may be\n\ngiven the day before the date of disconnection.\n\nG. The telephone company shall disconnect service to the person\n\non a determination by a court or the Oklahoma Corporation Commission\n\nthat the person is violating the provisions of this section, and may\n\nreconnect service to the person only on a determination by the court\n\nor the Oklahoma Corporation Commission that the person will comply\n\nwith this section.
