As used in this section:\n\n1. \"Hearing aid\" means any wearable instrument or device\n\ndesigned or offered for the purpose of aiding or compensating for\n\nimpaired human hearing and any parts, attachments, or accessories\n\nthereto, but excluding ear molds, batteries and cords. The term\n\n\"hearing aid\" does not include cochlear implants or cochlear\n\nprosthesis;\n\n2. \"Hearing aid provider\" means a hearing aid dealer or fitter\n\nlicensed pursuant to Section 1-1750 et seq. of Title 63 of the\n\nOklahoma Statutes, audiologist licensed pursuant to Section 1601 et\n\nseq. of Title 59 of the Oklahoma Statutes, or any other individual\n\nwho dispenses hearing aids within this state; and\n\n3. \"Rescission period\" means thirty (30) calendar days from the\n\nday the hearing aid is placed in the possession of the purchaser.\n\nB. A hearing aid provider shall provide a thirty-day rescission\n\nperiod on a hearing aid purchase consistent with the following\n\nterms:\n\n1. The purchaser shall have the right to cancel the purchase\n\nfor any reason if the hearing aid is returned to the hearing aid\n\nprovider in the same condition as when purchased, ordinary wear and\n\ntear excepted, within thirty (30) days of the date of receipt of the\n\nhearing aid. The thirty-day rescission period shall be tolled for\n\nany period during which the hearing aid provider takes possession or\n\ncontrol of a hearing aid after its original delivery;\n\n2. The purchaser is entitled to receive a full refund of the\n\npurchase price, provided the hearing aid provider may be entitled to\n\na cancellation fee no greater than ten percent (10%) of the total\n\npurchase price for the hearing aid or One Hundred Fifty Dollars\n\n($150.00) per hearing aid, whichever is less; and\n\n3. The hearing aid provider shall provide a written receipt or\n\ncontract to the purchaser that includes, in immediate proximity to\n\nthe space reserved for the signature of the purchaser, the following\n\nspecific statement in all bold-faced type capital letters no smaller\n\nthan the largest print used in the written receipt or contract:\n\nOKLAHOMA STATE LAW GIVES THE PURCHASER THE RIGHT TO\n\nCANCEL THIS PURCHASE FOR ANY REASON BY RETURNING THE HEARING\n\nAID TO THE HEARING AID PROVIDER AT ANY TIME PRIOR TO\n\nMIDNIGHT OF THE THIRTIETH CALENDAR DAY AFTER RECEIPT OF THE\n\nHEARING AID.\n\nBY LAW, THE HEARING AID PROVIDER MAY BE ENTITLED TO A\n\nCANCELLATION FEE NOT TO EXCEED TEN PERCENT (10%) OF THE\n\nTOTAL PURCHASE PRICE FOR THE HEARING AID OR ONE HUNDRED\n\nFIFTY DOLLARS ($150.00) PER HEARING AID, WHICHEVER IS LESS,\n\nTO COVER THE COSTS INCURRED BY THE HEARING AID PROVIDER.\n\nIF THE PURCHASER RETURNS THE HEARING AID WITHIN THE\n\nTHIRTY-DAY PERIOD, THE PURCHASER WILL RECEIVE A REFUND OF\n\n$____.00 (HEARING AID PROVIDER MUST INSERT THE DOLLAR AMOUNT\n\nOF THE REFUND).\n\nIF THE HEARING AID PROVIDER FAILS TO COMPLY WITH THIS\n\nPROVISION, COMPLAINTS SHOULD BE FORWARDED TO:\n\nOKLAHOMA STATE DEPARTMENT OF HEALTH\n\nOCCUPATIONAL LICENSING DIVISION\n\n1000 N.E. 10TH STREET\n\nOKLAHOMA CITY, OKLAHOMA 73105\n\nC. Failure to comply with this section constitutes a deceptive\n\ntrade practice.
