Stat. tit. 15, § 15-768","heading":"District attorney to receive copy of application -","body":"Objections - Grounds for denying application.\n\nUpon receipt of an application, the clerk shall forward a copy\n\nof the application to the district attorney of the same district the\n\ncourt clerk is located in who may cause an investigation as deemed\n\nnecessary for the facts contained therein. No license shall be\n\nissued by the clerk before ten (10) days has elapsed from the filing\n\nof the application within which period the district attorney may\n\nfile an objection to the application, setting forth one or more of\n\nthe following facts or circumstances, any one which shall be grounds\n\nfor denying the application for a license:\n\n1. That the applicant has been granted more than one license\n\nfor a \"closing out sale\" within thirty-six (36) months preceding the\n\ndate of the filing of the application;\n\n2. That the inventory includes goods, wares or merchandise on\n\nconsignment or purchased by the applicant or added to the stock in\n\ncontemplation of a closing out sale and for the purpose of selling\n\nthe same at such sale. For the purpose of this paragraph, any\n\nunusual addition to the stock of goods, wares and merchandise made\n\nwithin ninety (90) days prior to the filing of an application,\n\nunless so stated and explained in the application, shall be prima\n\nfacie evidence that such addition was made in contemplation of a\n\nclosing out sale and for the purpose of selling such stock at the\n\nsale;\n\n3. That the applicant, in the ticketing of the goods, wares and\n\nmerchandise to be offered at the sale, has misrepresented the value\n\nand original retail price of the goods; or\n\n4.
