Stat. tit. 15, § 15-769","heading":"Issuance of license - Conditions on sale","body":"If it appears to the clerk that all the statements in the\n\napplication are true, that the proposed sale is of the character\n\nrepresented therein, that the application is in full compliance with\n\nthe terms and conditions of the Oklahoma Consumer Protection Act,\n\nthat the required license fee has been paid, and that the ten-day\n\nwaiting period has expired with no objections from the district\n\nattorney, the clerk shall issue a license to the applicant\n\nauthorizing the advertising and conducting of the sale as described\n\nin the application, subject to the following conditions:\n\n1. Only the goods, wares, and merchandise included in the\n\ninventory attached to the application shall be sold at the sale;\n\n2. Upon the commencement of the sale and for its duration the\n\nlicense shall be prominently displayed in the place of sale by the\n\nlicensee;\n\n3. All advertisement of discount prices shall indicate that the\n\nprices are discounted from the manufacturer's suggested retail price\n\nand the manufacturer's suggested retail price shall be accurately\n\ndisplayed in such advertisements or all advertisements of discount\n\nprices shall indicate that the prices are discounted from the\n\nregular sales prices at which the merchandise has been offered at\n\nthe location of the sale for at least sixty (60) days prior to the\n\nsale and such regular prices shall be accurately displayed in\n\nadvertisements where discount prices are advertised by specific\n\ndollar amounts or percentage amounts of savings;\n\n4. No closing out sale shall be held at any location other than\n\nthe regular place of business of the licensee and the licensee shall\n\nhave conducted business at such location for a period of at least\n\nsix (6) months; and\n\n5. The licensee shall keep suitable books during the sale, at\n\nthe location at which the sale is conducted. Daily entries shall be\n\nmade in said books showing:\n\na. dollar amount of retail sales, and\n\nb. dollar amount of markdowns; for the purposes of\n\nthe Oklahoma Consumer Protection Act, the term markdowns is the\n\ndifference between retail and wholesale price of goods wholesaled by\n\nthe licensee, and\n\nc. dollar amount, both retail and cost price, of\n\ngoods on back order received, and\n\nd. dollar amount of wholesale sale.\n\nThe books shall be open for inspection during business\n\nhours by appropriate officials responsible for the enforcement of\n\nthis act.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bbc0afd728767f9ef33ce3eb42e16cdb40745921b10e198661eb5ce68b3dbe64","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-768","next":"us-ok/okla.-stat.-tit.-15-15-770"},"notice":"GroundRules: Original legal text.
