No telemarketer shall make or cause to be made any\n\nunsolicited telemarketing sales call or message, including, but not\n\nlimited to, a cellular telephone text message, to any consumer more\n\nthan thirty (30) days after the consumer’s telephone number or\n\nnumbers first appear on the registry made available by the Attorney\n\nGeneral pursuant to the Telemarketer Restriction Act.\n\nB. Willful violation of subsection A of this section shall be\n\nan unlawful telemarketing practice and a violation of the Oklahoma\n\nConsumer Protection Act; provided, a call to a consumer with whom\n\nthe caller has an established business relationship or a call or\n\ncellular telephone text message to a consumer whose number has been\n\nremoved from the registry shall not be a violation of the\n\nTelemarketer Restriction Act.\n\nC. In lieu of bringing an action under the Oklahoma Consumer\n\nProtection Act, the Attorney General may, in cases where the\n\ntelemarketer is able to demonstrate that the violation occurred\n\nnotwithstanding policies of the telemarketer that were an integral\n\npart of the training of the individual or individuals responsible\n\nfor the violation, assess an administrative fine.
