It shall be unlawful for a person to initiate an electronic\n\nmail message that the sender knows, or has reason to know:\n\n1. Misrepresents any information in identifying the point of\n\norigin or the transmission path of the electronic mail message;\n\n2. Does not contain information identifying the point of origin\n\nor the transmission path of the electronic mail message;\n\n3. Contains false, malicious, or misleading information which\n\npurposely or negligently injures a person;\n\n4. Falsely represents that it is being sent by a legitimate\n\nonline business;\n\n5. Refers or links the recipient of the message to a web page\n\nthat is represented as being associated with a legitimate online\n\nbusiness with the intent to engage in conduct involving the\n\nfraudulent use or possession of identifying information; or\n\n6. Directly or indirectly induces, requests, or solicits the\n\nrecipient of the electronic mail message to provide identifying\n\ninformation for a purpose the recipient believes is legitimate.\n\nB. Any person violating the provisions of this section shall be\n\nsubject to a civil penalty of up to Five Hundred Dollars ($500.00).\n\nC. All acts and practices declared to be unlawful by\n\nsubsections A and E of this section shall, in addition, be\n\nviolations of the Oklahoma Consumer Protection Act.\n\nD. For purposes of this section, an electronic mail message\n\nwhich is declared to be unlawful by subsection A of this section\n\nshall be considered a fraudulent electronic mail message or a\n\nfraudulent bulk electronic mail message and shall be deemed a Class\n\nD1 felony offense punishable by imprisonment as provided for in\n\nsubsections B through F of Section 20N of Title 21 of the Oklahoma\n\nStatutes.\n\nE. It shall be unlawful for any person to sell, give, or\n\notherwise distribute or possess with the intent to sell, give or\n\ndistribute software which:\n\n1. Is primarily designed or produced for the purpose of\n\nfacilitating or enabling the falsification of electronic mail\n\ntransmission information or other routing information;\n\n2. Has only limited commercially significant purpose or use\n\nother than to facilitate or enable the falsification of electronic\n\nmail transmission information or other routing information; or\n\n3. Is marketed by that person or another acting in concert with\n\nthat person and with that person’s knowledge for use in facilitating\n\nor enabling the falsification of electronic mail transmission\n\ninformation or other routing information.\n\nAny person who violates the provisions of this subsection shall,\n\nupon conviction, be guilty of a Class D1 felony offense and shall be\n\npunished by imprisonment as provided for in subsections B through F\n\nof Section 20N of Title 21 of the Oklahoma Statutes.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"bad4cf969dca0671e7769abc4a8df90167703e41fcb8eecff978d34d4bce730f","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-775c.6","next":"us-ok/okla.-stat.-tit.-15-15-776.10"},"notice":"GroundRules: Original legal text.
