Stat. tit. 15, § 15-776.11","heading":"Civil action – Standing – Remedies – Attorney fees and","body":"costs – Nature of violations.\n\nA. The following persons may bring a civil action against a\n\nperson who violates the Anti-Phishing Act:\n\n1. A person engaged in the business of providing Internet\n\naccess service to the public who is adversely affected by the\n\nviolation; or\n\n2. An owner of a web page or trademark who is adversely\n\naffected by the violation.\n\nB. A person bringing an action under this Act may:\n\n1. Seek injunctive relief to restrain the violator from\n\ncontinuing the violation;\n\n2. Recover damages in an amount equal to the greater of:\n\na. actual damages arising from the violation, or\n\nb. One Hundred Thousand Dollars ($100,000.00) for each\n\nviolation of the same nature; or\n\n3. Seek both injunctive relief and recover damages as provided\n\nfor in this subsection.\n\nC. The court may increase an award of actual damages in an\n\naction brought under this section to an amount not to exceed three\n\ntimes the actual damages sustained if the court finds that the\n\nviolations have occurred with a frequency as to constitute a pattern\n\nor practice.\n\nD. A plaintiff who prevails in an action filed under this\n\nsection is entitled to recover reasonable attorney fees and court\n\ncosts.\n\nE. For purposes of this section, violations are of the same\n\nnature if the violations consist of the same course of conduct or\n\naction, regardless of the number of times the conduct or act\n\noccurred.\n\nF.
