Stat. tit. 15, § 15-776.5","heading":"Commercial electronic mail – Definitions","body":"For purposes of Sections 1 through 3 of this act:\n\n1. “Electronic mail” means an electronic message or computer\n\nfile containing an image of a message that is transmitted between\n\ntwo or more computers or electronic terminals and includes\n\nelectronic messages that are transmitted within or between computer\n\nnetworks;\n\n2. “Electronic mail service provider” means any person who:\n\na. is an intermediary in sending or receiving electronic\n\nmail, and\n\nb. provides to end-users of electronic mail services the\n\nability to send or receive electronic mail;\n\n3. “Established business relationship” means a prior or\n\nexisting relationship formed by a voluntary communication between a\n\nperson or entity and the recipient with or without an exchange of\n\nconsideration, on the basis of an inquiry, application, purchase or\n\nuse by the recipient regarding products or services offered by such\n\nperson or entity;\n\n4. “Unsolicited commercial electronic mail message” means a\n\ncommercial electronic mail message sent without the consent of the\n\nrecipient, by a person with whom the recipient does not have an\n\nestablished business relationship. “Unsolicited commercial\n\nelectronic mail message” does not include electronic mail messages\n\nwhere the sender:\n\na. is an organization using electronic mail to\n\ncommunicate exclusively with its members,\n\nb. is an organization using electronic mail to\n\ncommunicate exclusively with its employees or\n\ncontractors, or both,\n\nc. has the consent of the recipient, or\n\nd. has an established business relationship with the\n\nrecipient, as defined in this section; and\n\n5. “Commercial electronic mail message” means an electronic\n\nmail message sent for the purpose of encouraging the purchase or\n\nrental of, or investment in, property, goods or services.\n\nCommercial electronic mail message does not include an electronic\n\nmail message:\n\na. to which an electronic mail service provider has\n\nattached an advertisement in exchange for free use of\n\nan electronic mail account, when the user has agreed\n\nto the arrangement,\n\nb. between persons with a prior business relationship, or\n\nc. between persons with a personal relationship.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f2df0202fc730a20b8b0bfc79752046dcb1cd36da62092466b49a29b2f9b6f29","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-776.4","next":"us-ok/okla.-stat.-tit.-15-15-776.6"},"notice":"GroundRules: Original legal text.
