It shall be a violation of this act and deemed a Class D1\n\nfelony offense for any person to transmit a commercial electronic\n\nmail message that:\n\n1. Falsifies electronic mail transmission information or other\n\nrouting information for the unsolicited commercial electronic\n\nmessage; or\n\n2. Contains false or misleading information in the subject\n\nline.\n\nB. It shall be a violation of this act and deemed a Class D1\n\nfelony offense for any person that sends a commercial electronic\n\nmail message to use a third party’s Internet address or domain name\n\nwithout the third party’s consent for the purpose of transmitting\n\nelectronic mail in a way that makes it appear that the third party\n\nwas the sender of such mail.\n\nC. It shall be a violation of this act and deemed a Class D1\n\nfelony offense for any person that sends an unsolicited commercial\n\nelectronic mail message to fail to use the exact characters “ADV:”\n\nas the first four characters in the subject line of an unsolicited\n\ncommercial electronic mail message.\n\nD. It shall be a violation of this act and deemed a Class D1\n\nfelony offense for any person that sends an unsolicited commercial\n\nelectronic mail message containing sexually explicit material, or\n\nadvertising sexually explicit goods or services, to fail to use the\n\nexact characters “ADV-ADULT:” as the first ten characters in the\n\nsubject line of such an unsolicited commercial electronic mail\n\nmessage.\n\nE. It shall be a violation of this act and deemed a Class D1\n\nfelony offense for any person that sends an unsolicited commercial\n\nelectronic mail message to fail to provide a mechanism allowing\n\nrecipients to easily and at no cost remove themselves from the\n\nsender’s electronic mail address lists so they are not included in\n\nfuture mailings. A sender of an unsolicited commercial electronic\n\nmail message shall remove the recipient from their electronic mail\n\nmessage list if the sender receives an electronic mail message from\n\nthe recipient to the sender-operated return electronic mail address\n\nthat indicates anywhere in the subject line or text that the\n\nrecipient wants their name removed from the list of the sender.\n\nF.
