No person for the duration of a declaration of emergency by\n\nthe Governor of this state or by the President of the United States\n\nand for thirty (30) days thereafter shall sell, rent, or lease, or\n\noffer to sell, rent, or lease, for delivery in the emergency area,\n\nany goods, services, dwelling units, or storage space in the\n\nemergency area at a rate or price which is more than ten percent\n\n(10%) above the rate or price charged by the person for the same or\n\nsimilar goods, services, dwelling units, or storage spaces\n\nimmediately prior to the declaration of emergency unless the\n\nincrease in the rate or price is attributable:\n\n1. To price increases in petroleum and natural gas commodity\n\nmarkets; or\n\n2. Only to factors unrelated to the emergency and does not\n\ninclude any increase in profit to the seller or owner.\n\nB. Upon the expiration of the period described in subsection A\n\nof this section and for one hundred eighty (180) days thereafter, no\n\nperson shall, within the emergency area, rent or lease or offer to\n\nrent or lease any dwelling unit or storage space or sell or offer to\n\nsell goods for use within the emergency area to repair, restore,\n\nremodel, or construct any dwelling unit for a price of more than ten\n\npercent (10%) above the price charged by that person for the\n\ndwelling unit, storage space, or goods immediately prior to the\n\ndeclaration of emergency unless the increase in the price is\n\nattributable to:\n\n1. Price increases in petroleum and natural gas commodity\n\nmarkets; or\n\n2. Factors unrelated to the emergency and does not include any\n\nincrease in profit to the seller or owner.\n\nC. A rate or price increase approved by the appropriate\n\ngovernmental agency is not a violation of this act.\n\nD. This section shall not apply to growers, producers, or\n\nprocessors of raw or processed food products, except for retail\n\nsales of such products to a consumer.\n\nE. This section shall not apply to sales, rentals, or leases of\n\ngoods from a catalog when the catalog is made available in the\n\nnormal course of business both prior to and after the declaration of\n\nemergency to all persons regardless of location in the emergency\n\narea.\n\nF.
