Stat. tit. 15, § 15-791","heading":"Definitions","body":"As used in this act:\n\n1. “Child sexual abuse material” means the same as used in\n\nSection 1024.1 of Title 21 of the Oklahoma Statutes;\n\n2. “Child sexual exploitation” means the same as used in\n\nSection 843.5 of Title 21 of the Oklahoma Statutes;\n\n3. “Commercial entity” means a corporation, limited liability\n\ncompany, partnership, limited partnership, sole proprietorship, or\n\nother legally recognized entity;\n\n4. “Digitized identification card” means a data file available\n\non any mobile device, which has connectivity to the Internet,\n\nthrough a state-approved application that allows the mobile device\n\nto download the data file from a state agency or any authorized\n\nagent of a state agency that contains all of the data elements\n\nvisible on the face and back of a license or identification card and\n\ndisplays the current state of the licensed or identification card;\n\n5. “Distribute” means to issue, sell, give, provide, deliver,\n\ntransfer, transmit, circulate, or disseminate by any means;\n\n6. “Harmful to minors” means the same as defined in Section\n\n1040.75 of Title 21 of the Oklahoma Statutes;\n\n7. “Internet” means the international computer network of both\n\nfederal and nonfederal interoperable packet switched data networks;\n\n8. “Minor” means any person eighteen (18) years of age or\n\nyounger;\n\n9. “News-gathering organization” means any of the following:\n\na. an employee of a newspaper, news publication, or news\n\nsource, printed or on an online or mobile platform, of\n\ncurrent news and public interest, while operating as\n\nan employee as provided in this subsection, who can\n\nprovide documentation of such employment with the\n\nnewspaper, news publication, or news source, or\n\nb. an employee of a radio broadcast station, television\n\nbroadcast station, cable television operator, or wire\n\nservice while operating as an employee as provided in\n\nthis subsection, who can provide documentation of such\n\nemployment;\n\n10. “Obscene” means the same as used in Section 1024.1 of Title\n\n21 of the Oklahoma Statutes;\n\n11. “Publish” means to communicate or make information\n\navailable to another person or entity on a publicly available\n\nInternet website;\n\n12. “Reasonable age verification methods” means verifying that\n\nthe person seeking access to the available material is eighteen (18)\n\nyears of age or older by using the following methods:\n\na. use of a digitized identification card as defined in\n\nthis section,\n\nb. verification through an independent, third-party age\n\nverification service that compares the personal\n\ninformation entered by the individual who is seeking\n\naccess to the material that is available from a\n\ncommercially available database, or aggregate of\n\ndatabases, that is regularly used by government\n\nagencies and businesses for purpose of age and\n\nidentity verification, or\n\nc. any commercially reasonable method that relies on\n\npublic or private transactional data to verify the age\n\nof the person attempting to access the material;\n\n13. “Substantial portion” means when more than a third of the\n\ntotal material available on the website meets the definition of\n\nmaterial harmful to minors as defined in this section; and\n\n14. “Transactional data” means a sequence of information that\n\ndocuments as exchange, agreement, or transfer between an individual,\n\ncommercial entity, or a third party used for the purpose of\n\nsatisfying a request or event.
