Any commercial entity that knowingly and intentionally\n\npublishes or distributes material harmful to minors on the Internet\n\nfrom a website that contains a substantial portion of such material\n\nshall provide Internet service subscribers and cellular service\n\nsubscribers the opportunity, before any individual using such\n\nservices may access the material, to request that access to the\n\nmaterial by subscription service be denied.\n\nB. Upon such request by an Internet service subscriber or\n\ncellular service subscriber, a commercial entity shall, without\n\ncharge, block access to its website on any device seeking to access\n\nits website using the subscriber’s Internet service or cellular\n\nservice subscription so that a minor does not receive material\n\nharmful to minors via that subscription.\n\nC. A commercial entity that fails to provide Internet service\n\nsubscribers or cellular service subscribers an opportunity to\n\nrequest that access to the commercial entity’s website be blocked is\n\nin violation of this act and may be held liable to the minor, by and\n\nthrough the minor’s parent or legal guardian, for nominal damages,\n\nactual damages, court costs, and reasonable attorney fees as ordered\n\nby the court.\n\nD. A commercial entity that, after receipt of such request to\n\nblock access, allows a minor to access material harmful to minors on\n\nits website is in violation of this act and may be held liable to\n\nthe minor, by and through the minor’s parent or legal guardian, for\n\nactual damages, court costs, and reasonable attorney fees as ordered\n\nby the court.\n\nE. A commercial entity that has violated this act in a manner\n\nthat satisfies the standards for imposition of punitive damages\n\nelsewhere provided by law may be held liable to the minor, by and\n\nthrough the minor’s parent or legal guardian, for punitive damages.\n\nF. Individual claims that satisfy the generally applicable\n\nstandards for joinder or class action elsewhere provided by law or\n\nrules of court, as applicable, may combine their claims in a single\n\naction.\n\nG. A commercial entity shall not be held liable for allowing\n\naccess to its website if the entity performs reasonable age\n\nverification methods to verify that the individual attempting to\n\naccess the material from its website is not a minor.\n\nH. A commercial entity or third party that performs reasonable\n\nage verification methods shall not retain any identifying\n\ninformation of the individual after access has been granted to the\n\nmaterial.\n\nI. A commercial entity that is found to have knowingly retained\n\nidentifying information of the individual, except as is reasonably\n\nnecessary to effectuate a block request under this section, shall be\n\nliable to the individual for damages resulting from retaining the\n\nidentifying information, including court costs and reasonable\n\nattorney fees as ordered by the court.\n\nJ. This section shall not apply to any bona fide news or public\n\ninterest broadcast, website video, report, or event and shall not be\n\nconstrued to affect the rights of a news-gathering organization,\n\nunless the organization’s website contains a substantial portion of\n\nmaterial harmful to minors.\n\nK. No Internet service provider, affiliate or subsidiary of an\n\nInternet service provider, search engine, or cloud service provider\n\nshall be held to have violated the provisions of this section solely\n\nfor providing access or connection to or from a website or other\n\ninformation or content on the Internet, or a facility, system, or\n\nnetwork not under the provider’s control, including transmission,\n\ndownloading, storing, or providing access, to the extent that such\n\nprovider is not responsible for the creation of the content of the\n\ncommunication that constitutes obscene material or material harmful\n\nto minors.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"34ad7fc9bd1c4cf0979f266c6a52bbb7d33ac74048efcb1bdf991d6d88f6e48b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-791.1","next":"us-ok/okla.-stat.-tit.-15-15-791.3"},"notice":"GroundRules: Original legal text.
