Stat. tit. 15, § 15-799A.2","heading":"Definitions","body":"As used in the Oklahoma INFORM Act:\n\n1. \"Consumer product\" means any tangible personal property\n\nwhich is distributed in commerce and which is normally used for\n\npersonal, family, or household purposes including any such property\n\nintended to be attached to or installed in any real property without\n\nregard to whether it is so attached or installed;\n\n2. \"High-volume third-party seller\" means a participant in an\n\nonline marketplace who is a third-party seller and who, in any\n\ncontinuous twelve-month period during the previous twenty-four (24)\n\nmonths, has entered into two hundred or more discrete sales or\n\ntransactions of new or unused consumer products and an aggregate\n\ntotal of Five Thousand Dollars ($5,000.00) or more in gross\n\nrevenues. For purposes of calculating the number of discrete sales\n\nor transactions or the aggregate gross revenues, an online\n\nmarketplace shall only be required to count sales or transactions\n\nmade through the online marketplace and for which payment was\n\nprocessed by the online marketplace, either directly or through its\n\npayment processor;\n\n3. \"Online marketplace\" means any person or entity that\n\noperates a consumer-directed electronically based or accessed\n\nplatform that:\n\na. includes features that allow for, facilitate, or\n\nenable third-party sellers to engage in the sale,\n\npurchase, payment, storage, shipping, or delivery of a\n\nconsumer product in this state,\n\nb. is used by one or more third-party sellers for such\n\npurposes, and\n\nc. has a contractual or similar relationship with\n\nconsumers governing their use of the platform to\n\npurchase consumer products;\n\n4. \"Seller\" means a person who sells, offers to sell, or\n\ncontracts to sell a consumer product through an online marketplace's\n\nplatform;\n\n5. \"Third-party seller\" means any seller, independent of an\n\nonline marketplace, who sells, offers to sell, or contracts to sell\n\na consumer product in this state through an online marketplace. The\n\nterm third-party seller does not include:\n\na. a seller who operates the online marketplace's\n\nplatform, or\n\nb. a business entity that has:\n\n(1) made available to the general public the entity's\n\nname, business address, and working contact\n\ninformation,\n\n(2) an ongoing contractual relationship with the\n\nonline marketplace to provide the online\n\nmarketplace with the manufacture, distribution,\n\nwholesaling, or fulfillment of shipments of\n\nconsumer products, and\n\n(3) provided to the online marketplace identifying\n\ninformation, as described in Section 3 of this\n\nact, that has been verified in accordance with\n\nthat section; and\n\n6. \"Verify\" means to confirm information provided to an online\n\nmarketplace pursuant to this act, and may include the use of one or\n\nmore methods that enable the online marketplace to reliably\n\ndetermine that any information and documents provided are valid,\n\ncorresponding to the seller or an individual acting on the seller's\n\nbehalf, not misappropriated, and not falsified.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8e3f96b862c89f11c71a801f30769843e8528de5163ebf14c5cfb5c4feae8b38","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-799a.1","next":"us-ok/okla.-stat.-tit.-15-15-799a.3"},"notice":"GroundRules: Original legal text.
