Online marketplaces shall require that any high-volume\n\nthird-party seller on the online marketplace's platform provide the\n\nonline marketplace with the following information no later than ten\n\n(10) calendar days after qualifying as a high-volume third-party\n\nseller on the platform:\n\n1. A bank account number, or, if the high-volume third-party\n\nseller does not have a bank account, the name of the payee for\n\npayments issued by the online marketplace to the high-volume third-\n\nparty seller. Such bank account or payee information may be\n\nprovided by the seller either:\n\na. to the online marketplace, or\n\nb. to other third parties contracted by the online\n\nmarketplace to maintain such information, provided\n\nthat the online marketplace ensures that it can obtain\n\nsuch information on demand from such other third\n\nparties;\n\n2. Contact information including:\n\na. if the high-volume third-party seller is an\n\nindividual, the individual's name, or\n\nb. if the high-volume third-party seller is not an\n\nindividual, one of the following forms of contact\n\ninformation:\n\n(1) a copy of a valid government-issued\n\nidentification for an individual acting on behalf\n\nof such seller that includes the individual's\n\nname, or\n\n(2) a copy of a valid government-issued record or tax\n\ndocument that includes the business name and\n\nphysical address of such seller;\n\n3. A business tax identification number or, if the high-volume\n\nthird-party seller does not have a business tax identification\n\nnumber, a taxpayer identification number; and\n\n4. A current working email address and phone number for the\n\nhigh-volume third-party seller.\n\nB. An online marketplace shall:\n\n1. Periodically, but not less than annually, notify any high-\n\nvolume third-party seller on such online marketplace's platform of\n\nthe requirement to keep any information collected under subsection A\n\nof this section current; and\n\n2. Require any high-volume third-party seller on such online\n\nmarketplace's platform to, not later than ten (10) calendar days\n\nafter receiving the notice under paragraph 1 of this subsection,\n\nelectronically certify that:\n\na. the high-volume third-party seller has provided any\n\nchanges to such information to the online marketplace,\n\nif such changes have occurred,\n\nb. there have been no changes to the high-volume third-\n\nparty seller's information, or\n\nc. the high-volume third-party seller has provided any\n\nchanges to such information to the online marketplace.\n\nC. In the event that a high-volume third-party seller does not\n\nprovide the information or certification required under this\n\nparagraph, the online marketplace shall, after providing the seller\n\nwith written or electronic notice and an opportunity to provide such\n\ninformation or certification not later than ten (10) calendar days\n\nafter the issuance of such notice, suspend any future sales activity\n\nof such seller until such seller provides such information or\n\ncertification.\n\nD. 1. The online marketplace shall:\n\na. verify the information collected under subsection A of\n\nthis section not later than ten (10) calendar days\n\nafter such collection, and\n\nb. verify any change to such information not later than\n\nten (10) calendar days after being notified of such\n\nchange by a high-volume third-party seller under\n\nsubsection B of this section.\n\n2. In the case of a high-volume third-party seller that\n\nprovides a copy of a valid government-issued tax document, any\n\ninformation contained in such document shall be presumed to be\n\nverified as of the date of issuance of such document.\n\nE. Data collected solely to comply with the requirements of\n\nthis section may not be used for any other purpose unless required\n\nby law.\n\nF. An online marketplace shall implement and maintain\n\nreasonable security procedures and practices including\n\nadministrative, physical, and technical safeguards, appropriate to\n\nthe nature of the data and the purposes for which the data will be\nsuch document.\n\nE. Data collected solely to comply with the requirements of\n\nthis section may not be used for any other purpose unless required\n\nby law.\n\nF.
