Stat. tit. 15, § 15-910.1","heading":"Definitions","body":"As used in the Defective Assistive Device Act:\n\n1. \"Assistive device\" means any device, including a\n\ndemonstrator, that a consumer purchases or accepts transfer of in\n\nthis state which is used for a major life activity which includes,\n\nbut is not limited to:\n\na. manual wheelchairs, motorized wheelchairs, motorized\n\nscooters, and other aids that enhance the mobility of\n\nan individual,\n\nb. hearing aids, telecommunications devices for the deaf\n\n(TDD), assistive listening devices, and other aids\n\nthat enhance an individual's ability to hear,\n\nc. voice-synthesized computer modules, optical scanners,\n\ntalking software, braille printers, and other devices\n\nthat enhance a sight-impaired individual's ability to\n\ncommunicate, and\n\nd. any other assistive device that enables a person with\n\na disability to communicate, see, hear, or maneuver;\n\n2. \"Assistive device dealer\" means a person who is in the\n\nbusiness of selling assistive devices;\n\n3. \"Assistive device lessor\" means a person who leases an\n\nassistive device to a consumer, or who holds the lessor's rights\n\nunder a written lease;\n\n4. \"Collateral costs\" means expenses incurred by a consumer in\n\nconnection with the repair of a nonconformity, including the costs\n\nof obtaining an alternative assistive device;\n\n5. \"Consumer\" means any of the following:\n\na. the purchaser of an assistive device, if the assistive\n\ndevice was purchased from an assistive device dealer\n\nor manufacturer for purposes other than resale,\n\nb. a person to whom the assistive device is transferred\n\nfor purposes other than resale, if the transfer occurs\n\nbefore the expiration of an express warranty\n\napplicable to the assistive device,\n\nc. a person who may enforce the warranty, or\n\nd. a person who leases an assistive device from an\n\nassistive device lessor under a written lease;\n\n6. \"Demonstrator\" means an assistive device used primarily for\n\nthe purpose of demonstration to the public;\n\n7. \"Early termination cost\" means any expense or obligation\n\nthat an assistive device lessor incurs as a result of both the\n\ntermination of a written lease before the termination date set forth\n\nin that lease and the return of an assistive device to a\n\nmanufacturer pursuant to the Defective Assistive Device Act. Early\n\ntermination cost includes a penalty for prepayment under a finance\n\narrangement;\n\n8. \"Early termination saving\" means any expense or obligation\n\nthat an assistive device lessor avoids as a result of both the\n\ntermination of a written lease before that termination date set\n\nforth in that lease and the return of an assistive device to a\n\nmanufacturer pursuant to the Defective Assistive Device Act. Early\n\ntermination saving includes an interest charge that the assistive\n\ndevice lessor would have paid to finance the assistive device or, if\n\nthe assistive device lessor does not finance the assistive device,\n\nthe difference between the total amount for which the lease\n\nobligates the consumer during the period of the lease term remaining\n\nafter the early termination and the present value of that amount at\n\nthe date of the early termination;\n\n9. \"Manufacturer\" means a person who manufactures or assembles\n\nassistive devices and agents of that person, including an importer,\n\na distributor, factory branch, distributor branch and any warrantors\n\nof the manufacturer's assistive device, but does not include an\n\nassistive device dealer;\n\n10. \"Nonconformity\" means a condition or defect that\n\nsubstantially impairs the value or safety of an assistive device,\n\nand that is covered by an express warranty applicable to the\n\nassistive device or to a component of the assistive device, but does\n\nnot include a condition or defect that is the result of abuse,\n\nneglect or unauthorized modification or alteration of the assistive\n\ndevice by a consumer; and\n\n11. \"Reasonable attempt to repair\" means within the terms of an\noma Statutes - Title 15. Contracts Page 216\n\nand that is covered by an express warranty applicable to the\n\nassistive device or to a component of the assistive device, but does\n\nnot include a condition or defect that is the result of abuse,\n\nneglect or unauthorized modification or alteration of the assistive\n\ndevice by a consumer; and\n\n11. \"Reasonable attempt to repair\" means within the terms of an\n\nexpress warranty applicable to a new assistive device:\n\na. any nonconformity within the warranty that is either\n\nsubject to repair by the manufacturer, assistive\n\ndevice lessor or any of the manufacturer's authorized\n\nassistive device dealers for at least four times, and\n\na nonconformity continues, or\n\nb. the assistive device is out of service for an\n\naggregate of at least thirty (30) cumulative days\n\nbecause of warranty nonconformity.","path":["OK Code","Title 15"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os15.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"af3b62cce3c997f26ffae6271db8546cde19613653cd0c2679661288e6f17c92","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-15-15-910","next":"us-ok/okla.-stat.-tit.-15-15-910.2"},"notice":"GroundRules: Original legal text.
