If, after a reasonable attempt to repair, the nonconformity\n\nis not repaired, then at the direction of a consumer described under\n\nsubparagraph a, b or c of paragraph 5 of Section 2 of this act, the\n\nmanufacturer shall do one of the following:\n\n1. Accept return of the assistive device and replace the\n\nassistive device with a comparable new assistive device and refund\n\nany collateral costs; or\n\n2. Accept return of the assistive device and refund to the\n\nconsumer and to any holder of a perfected security interest in the\n\nconsumer's assistive device, as their interest may appear, the full\n\npurchase price plus any finance charge amount paid by the consumer\n\nat the point of sale and collateral costs, less a reasonable\n\nallowance for use. A reasonable allowance for use may not exceed\n\nthe amount obtained by multiplying the full purchase price of the\n\nassistive device by a fraction, the denominator of which is one\n\nthousand eight hundred twenty-five (1,825) and the numerator of\n\nwhich is the number of days that the assistive device was used\n\nbefore the consumer first reported the nonconformity to the\n\nassistive device dealer.\n\nB. 1. With respect to a consumer described under subparagraph\n\nd of paragraph 5 of Section 2 of this act, accept return of the\n\nassistive device, refund to the assistive device lessor and to any\n\nholder of a perfected security interest in the assistive device, as\n\ntheir interest may appear, the current value of the written lease\n\nand refund to the consumer the amount that the consumer paid under\n\nthe written lease plus any collateral costs, less a reasonable\n\nallowance for use.\n\n2. The current value of the written lease equals the total\n\namount for which that lease obligates the consumer during the period\n\nof the lease remaining after its early termination, plus the\n\nassistive device dealer's early termination costs and the value of\n\nthe assistive device at the lease expiration date if the lease sets\n\nforth that value less the assistive device lessor's early\n\ntermination savings.\n\n3.
