Stat. tit. 16, § 16-202","heading":"Rights and duties of parties","body":"Any contract hereafter made in this state for the purchase and\n\nsale of realty shall be interpreted as including an agreement that\n\nthe parties shall have the following rights and duties, unless the\n\ncontract expressly provides otherwise;\n\n(a) if, when neither the legal title nor the possession of the\n\nsubject matter of the contract has been transferred, all or a\n\nmaterial part thereof is destroyed without fault of this purchaser\n\nor is taken by eminent domain, the vendor cannot enforce the\n\ncontract, and the purchaser is entitled to recover any portion of\n\nthe price that he has paid; or\n\n(b) if, when either the legal title or the possession of the\n\nsubject matter of the contract has been transferred, all or any part\n\nthereof is destroyed without fault of the vendor or is taken by\n\neminent domain, the purchaser is not thereby relieved from a duty to\n\npay the price, nor is he entitled to recover any portion thereof\n\nthat he has paid.","path":["OK Code","Title 16"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os16.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4675b068a4b10cc899c0d763e29b731d921cb9e44bae53172e30b421e435fa8c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-16-16-201","next":"us-ok/okla.-stat.-tit.-16-16-203"},"notice":"GroundRules: Original legal text.
