Stat. tit. 16, § 16-27a","heading":"Instruments recorded for five (5) years valid","body":"notwithstanding defects - Evidence.\n\nA. When any instrument shall have been recorded in the office\n\nof the county clerk in the proper county for the period of five (5)\n\nyears, and the instrument contains any of the following defects:\n\n1. It has not been signed by the proper representative of a\n\nlegal entity;\n\n2. The representative is not authorized to execute the\n\ninstrument on behalf of the legal entity;\n\n3. A power of attorney has not been filed of record for an\n\nattorney in fact executing the instrument;\n\n4. The seal of the legal entity has not been impressed on such\n\ninstrument or the record does not show such seal;\n\n5. The instrument is not acknowledged;\n\n6. A deed or conveyance does not bear endorsement of approval\n\nby the appropriate governmental planning authority having\n\njurisdiction; or\n\n7. Any defect in the execution, acknowledgment, recording or\n\ncertificate of recording the same,\n\nsuch instrument shall, from and after the expiration of five (5)\n\nyears from the filing thereof for record, be valid as though such\n\ninstrument had, in the first instance, been in all respects duly\n\nexecuted, acknowledged, approved by the appropriate planning\n\nauthority having jurisdiction, and certified. Such instrument or\n\nthe record thereof or a duly-authenticated copy thereof shall be\n\ncompetent evidence without requiring the original to be produced or\n\naccounted for to the same extent that written instruments, duly\n\nexecuted and acknowledged, or the record thereof, are competent.\n\nHowever, nothing herein contained shall be construed to affect any\n\nrights acquired by grantees, assignees or encumbrancers subsequent\n\nto the filing of such instrument for record and prior to the\n\nexpiration of five (5) years from the filing of such instrument for\n\nrecord.\n\nB. This section shall apply to instruments recorded before or\n\nafter November 1, 1995.
