A service agreement is unfair under this act if any part of\n\nthe service subject to the agreement is not to be performed within\n\none (1) year after the time it is entered into or automatically\n\nrenews after a one (1) year agreement timeframe and has any of the\n\nfollowing characteristics:\n\n1. Purports to run with the land or to be binding on future\n\nowners of interests in the real property;\n\n2. Allows for assignment of the right to provide service\n\nwithout notice to and consent of the owner of residential real\n\nestate; or\n\n3. Purports to create a lien, encumbrance, or other real\n\nproperty security interest.\n\nB. This act does not apply to:\n\n1. A home warranty or similar product that covers the cost of\n\nmaintenance of a major home system, such as plumbing, HVAC or\n\nelectrical wiring for a fixed period;\n\n2. An insurance contract;\n\n3. An option or right of refusal to purchase the residential\n\nreal estate;\n\n4. A declaration created in the formation of a common-interest\n\ncommunity or an amendment thereto;\n\n5. A maintenance or repair agreement entered by an owners'\n\nassociation in a common-interest community;\n\n6. A mortgage loan or a commitment to make or receive a\n\nmortgage loan;\n\n7. A security agreement under the Uniform Commercial Code\n\nrelating to the sale or rental of personal property or fixtures; or\n\n8. Water, sewer, electrical, telephone, cable, or other\n\nregulated utility service providers.\n\nC.
