Stat. tit. 16, § 16-402","heading":"Definitions","body":"As used in this act:\n\n1. \"Amendment\" means a document that removes an unlawful\n\nrestriction;\n\n2. \"Document\" means a record recorded or eligible to be\n\nrecorded in land records;\n\n3. \"Governing instrument\" means a document recorded in land\n\nrecords that:\n\na. establishes a governing body responsible for\n\nmanagement of common areas or facilities used by more\n\nthan one owner of a property interest affected by the\n\ndocument, and\n\nb. requires contribution, enforceable by a lien on a\n\nseparate property interest, of a share of taxes,\n\ninsurance premiums, maintenance, or improvement of, or\n\nservices or other expenses for the common benefit of,\n\nthe real property described in the document;\n\n4. \"Index\" means a system that enables a search for a document\n\nin land records;\n\n5. \"Land records\" means documents and indexes maintained by a\n\nrecorder;\n\n6. \"Owner\" means a person that has a fee interest in real\n\nproperty;\n\n7. \"Person\" means an individual, estate, business or nonprofit\n\nentity, government or governmental subdivision, agency, or\n\ninstrumentality, or other legal entity;\n\n8. \"Record\", used as a noun, means information:\n\na. inscribed on a tangible medium, or\n\nb. stored in an electronic or other medium and\n\nretrievable in perceivable form;\n\n9. \"Recorder\" means an officer authorized under other laws of\n\nthis state to accept a document for recordation in land records;\n\n10. \"Remove\" means eliminate any apparent or purportedly\n\ncontinuing effect on title to real property; and\n\n11. \"Unlawful restriction\" means a prohibition, restriction,\n\ncovenant, or condition in a document that purports to interfere with\n\nor restrict the transfer, use, or occupancy of real property:\n\na. on the basis of race, color, religion, national\n\norigin, sex, familial status, disability, or other\n\npersonal characteristics, and\n\nb. in violation of other laws of this state or federal\n\nlaw.","path":["OK Code","Title 16"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os16.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5eb42cb438217126863def1bcd679cad53b12db8ea23fb2d401383c1048e7c07","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-16-16-401","next":"us-ok/okla.-stat.-tit.-16-16-403"},"notice":"GroundRules: Original legal text.
