Stat. tit. 16, § 16-7","heading":"Husband or wife of incapacitated spouse may sell, convey,","body":"lease or mortgage homestead held in joint tenancy.\n\nIn case of a homestead held in joint tenancy, if one spouse\n\nbecomes incapacitated, upon application of the other spouse to the\n\ndistrict court of the county in which the homestead is located, and\n\nupon due proof of said incapacity, the court may issue an order\n\npermitting said other spouse to sell, convey, lease, lease for oil\n\nand gas mining purposes, or mortgage the homestead.
