Stat. tit. 16, § 16-72","heading":"Title subject to certain interests and defects","body":"Such marketable record title shall be subject to:\n\n(a) All interests and defects which are inherent in the\n\nmuniments of which such chain of record title is formed; provided,\n\nhowever, that a general reference in such muniments, or any of them,\n\nto interests created prior to the root of title shall not be\n\nsufficient to preserve them, unless specific identification be made\n\ntherein of a recorded title transaction which creates such interest.\n\n(b) All interests preserved by the filing of proper notice or\n\nby possession by the same owner continuously for a period of thirty\n\n(30) years or more, in accordance with Section 74 of this title.\n\n(c) The rights of any person arising from a period of adverse\n\npossession or user, which was in whole or in part subsequent to the\n\neffective date of the root of title.\n\n(d) Any interest relating to a title transaction which has been\n\nrecorded subsequent to the effective date of the root of title from\n\nwhich the unbroken chain of title of record is started; provided,\n\nhowever, that such recording shall not revive or give validity to\n\nany interest which has been extinguished prior to the time of the\n\nrecording by the operation of Section 73 of this title.\n\n(e) The exceptions stated in Section 76 of this title as to\n\nrights of reversioners in leases, as to severed mineral or royalty\n\ninterests, as to easements and interests in the nature of easements,\n\nand rights granted, reserved or excepted by instruments creating\n\nsuch easements or interests, or restrictions or agreements which are\n\npart of a subdivision development plan, and as to interests of the\n\nUnited States.","path":["OK Code","Title 16"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os16.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"34e80dbb260bb52a6708853b87b9a98665243f7a023e5cf43ca2790d80fc42a4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-16-16-71","next":"us-ok/okla.-stat.-tit.-16-16-73"},"notice":"GroundRules: Original legal text.
