Stat. tit. 16, § 16-74","heading":"Filing of notice of claim - Disability or lack of knowledge","body":"- Thirty-year possession as deemed equivalent to filing notice.\n\n(a) Any person claiming an interest in land may preserve and\n\nkeep effective such interest by filing for record during the thirty-\n\nyear period immediately following the effective date of the root of\n\ntitle of the person whose record title would otherwise be\n\nmarketable, a notice in writing, duly verified by oath, setting\n\nforth the nature of the claim. No disability or lack of knowledge\n\nof any kind on the part of anyone shall suspend the running of said\n\nthirty-year period. Such notice may be filed for record by the\n\nclaimant or by any other person acting on behalf of any claimant who\n\nis\n\n(1) under a disability,\n\n(2) unable to assert a claim on his own behalf, or\n\n(3) one of a class, but whose identity cannot be established or\n\nis uncertain at the time of filing such notice of claim for record.\n\n(b) If the same record owner of any possessory interest in land\n\nhas been in possession of such land continuously for a period of\n\nthirty (30) years or more, during which period no title transaction\n\nwith respect to such interest appears of record in his chain of\n\ntitle, and no notice has been filed by him or on his behalf as\n\nprovided in subsection (a), and such possession continues to the\n\ntime when marketability is being determined, such period of\n\npossession shall be deemed equivalent to the filing of the notice\n\nimmediately preceding the termination of the thirty-year period\n\ndescribed in subsection (a).","path":["OK Code","Title 16"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os16.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a959464c6c737215c4b180ee6aa4b4e531128f67097c5d9034ff833a7571695c","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-16-16-73","next":"us-ok/okla.-stat.-tit.-16-16-75"},"notice":"GroundRules: Original legal text.
