Stat. tit. 16, § 16-87","heading":"Recordation of electronic documents in tangible form","body":"RECORDATION OF ELECTRONIC DOCUMENTS IN TANGIBLE FORM. A. As\n\nused in this section:\n\n1. \"Document\" means information that is:\n\na. inscribed on a tangible medium or that is stored in an\n\nelectronic or other medium and is retrievable in\n\nperceivable form, and\n\nb. eligible to be recorded in the office of the county\n\nclerk;\n\n2. \"Electronic\" means relating to technology having electrical,\n\ndigital, magnetic, wireless, optical, electromagnetic or similar\n\ncapabilities;\n\n3. \"Electronic document\" means a document created, generated,\n\nsent, communicated, received or stored by electronic means; and\n\n4. \"Electronic signature\" means an electronic sound, symbol or\n\nprocess attached to or logically associated with an electronic\n\ndocument and executed or adopted by a person with the intent to sign\n\nthe electronic document.\n\nB. A paper or tangible copy of an electronic document that a\n\nnotary public has certified to be a true and correct copy under\n\nsubsection C of this section satisfies any requirement of law that,\n\nas a condition for recording, the document:\n\n1. Be an original or be in writing;\n\n2. Be signed or contain an original signature, if the document\n\ncontains an electronic signature of the person required to sign the\n\ndocument; and\n\n3. Be notarized, acknowledged, verified, witnessed or made\n\nunder oath, if the document contains an electronic signature of the\n\nperson authorized to perform that act, and all other information\n\nrequired to be included.\n\nC. A notary public commissioned under Section 1 of Title 49 of\n\nthe Oklahoma Statutes may certify that a paper or tangible copy of\n\nan electronic document is a true and correct copy of the electronic\n\ndocument if the notary public has:\n\n1. Reasonably confirmed that the electronic document is in a\n\ntamper-evident format;\n\n2. Detected no changes or errors in any electronic signature or\n\nother information in the electronic document;\n\n3. Personally printed or supervised the printing of the\n\nelectronic document onto paper or other tangible medium; and\n\n4. Not made any changes or modifications to the electronic\n\ndocument or to the paper or tangible copy thereof other than the\n\ncertification described in this subsection.\n\nD. A county clerk shall record a paper or tangible copy of a\n\ndocument that is otherwise entitled to be recorded under the laws of\n\nthis state, provided that the paper or tangible copy has been\n\ncertified by a notary public to be a true and correct copy of an\n\nelectronic document under subsection C of this section as evidenced\n\nby a certificate. The certificate shall be completed in the manner\n\nrequired in subsection A of Section 118 of Title 49 of the Oklahoma\n\nStatutes.\n\nE. The following form of certificate is sufficient for the\n\npurposes of this section if completed in the manner required by\n\nsubsection D of this section:\n\nState of\n\nCounty of\n\nI certify that the preceding or attached document (entitled\n\n(document title)), (dated (document date)), containing (number)\n\npages is a true and correct copy of an electronic document printed\n\nby me or under my supervision, and that, at the time of printing, no\n\nsecurity features present on the electronic document indicated any\n\nchanges or errors in an electronic signature or other information in\n\nthe electronic document since its creation or execution.\n\nDated\n\n(Signature of notary public)\n\n(Notary seal)\n\nNotary Public\n\n(My commission expires: )\n\nF. If a certificate is completed in the manner required by\n\nsubsection D of this section and is attached to or made a part of a\n\npaper or tangible document, the certificate is prima facie evidence\n\nthat the requirements of subsection C of this section have been\n\nsatisfied with respect to the document.\n\nG. When any paper or tangible copy of an electronic document\n\nshall have been recorded in the office of the county clerk in the\nd in the manner required by\n\nsubsection D of this section and is attached to or made a part of a\n\npaper or tangible document, the certificate is prima facie evidence\n\nthat the requirements of subsection C of this section have been\n\nsatisfied with respect to the document.\n\nG. When any paper or tangible copy of an electronic document\n\nshall have been recorded in the office of the county clerk in the\n\nproper county, and the document was not certified in accordance with\n\nthis section, such document shall, from and after the time of the\n\nfiling thereof for record, be valid as though such document had, in\n\nthe first instance, been in all respects duly certified in\n\naccordance with this section. Such document or the record thereof\n\nor a duly authenticated copy thereof shall be competent evidence\n\nwithout requiring the original to be produced or accounted for to\n\nthe same extent that written documents, duly executed and\n\nacknowledged, or the record thereof are competent. This subsection\n\nshall apply to documents recorded before or after January 1, 2020.\n\nH. This section does not apply to a plat, plan, map or survey\n\nof real property if under another law of this state or a rule,\n\nregulation or ordinance applicable to a county clerk:\n\n1. There are requirements of format or medium for the\n\nexecution, creation or recordation of such plat, plan, map or survey\n\nbeyond the requirements applicable to a deed to real property; or\n\n2.
