Stat. tit. 17, § 17-136","heading":"Extension of telephone service to open territories -","body":"Petition - Notice and hearing.\n\nUpon the petition of any citizens residing in territory which is\n\nopen territory, requesting telephone service from an adjacent\n\ntelephone exchange, the Commission may cause the same to be set for\n\nhearing and give due and proper notice in writing, at least ten (10)\n\ndays prior to the date of hearing, to all persons, firms or\n\ncorporations holding certificates to furnish service in adjacent\n\nterritory or furnishing service in adjacent territory and to the\n\nmunicipal officials of all municipalities in said affected\n\nterritories, and by publication for one (1) week in a newspaper of\n\ngeneral circulation in the territory affected. If, at such hearing,\n\nthe Commission finds from competent evidence that the public\n\nconvenience and necessity requires the furnishing of telephone\n\nservice in the affected territory, it shall have the further power\n\nto order and direct the person, firm, association, corporation or\n\ncooperative which can most economically extend its service so as to\n\nfurnish efficient telephone service in the affected territory to so\n\nextend its service, provided that it shall not make an order so\n\nrequiring unless it finds, from substantial evidence, that the\n\nperson, firm or corporation so ordered to serve is earning a fair\n\nreturn on the fair value of its property devoted by it to the public\n\nservice in this state and that the rendition of service in the\n\naffected territory will not prevent the person, firm or corporation\n\nso ordered to serve from earning a fair return on the fair value of\n\nits property devoted to the public service in this state.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7a77a5d9a8e871feb960ff129134750f8e9e8b24246050707783094aec6ad641","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-134","next":"us-ok/okla.-stat.-tit.-17-17-137"},"notice":"GroundRules: Original legal text.
