The Oklahoma Lifeline Fund (OLF) and the Oklahoma Universal\n\nService Fund (OUSF) shall be funded in a competitively neutral\n\nmanner not inconsistent with federal law by all contributing\n\nproviders. The funding from each contributing provider shall be\n\nbased on the total intrastate retail Oklahoma Voice over Internet\n\nProtocol (VoIP) revenues and intrastate telecommunications revenues,\n\nfrom both regulated and unregulated services, of the contributing\n\nprovider, hereinafter referred to as assessed revenues, as a\n\npercentage of all assessed revenues of the contributing providers,\n\nor such other assessment methodology not inconsistent with federal\n\nlaw. VoIP services shall be assessed only as provided for in the\n\ndecision of the Federal Communications Commission, FCC 10-185,\n\nreleased November 5, 2010, or such other assessment methodology that\n\nis not inconsistent with federal law. The Commission may after\n\nnotice and hearing modify the contribution methodology for the OUSF\n\nand OLF, provided the new methodology is not inconsistent with\n\nfederal law.\n\nB. The Corporation Commission shall establish the OLF\n\nassessment and the OUSF assessment at a level sufficient to recover\n\ncosts of administration and payments for OUSF and OLF requests for\n\nfunding as provided for in the Oklahoma Telecommunications Act of\n\n1997. The administration of the OLF and OUSF shall be provided by\n\nthe Public Utility Division of the Commission. The administrative\n\nfunction shall be headed by the Administrator as defined in Section\n\n139.102 of this title. The Administrator shall be an independent\n\nevaluator. The Administrator may enter into contracts to assist\n\nwith the administration of the OLF and OUSF.\n\nC. If the Commission determines after notice and hearing that a\n\ncontributing provider has acted in violation of this section, in\n\naddition to the other enforcement powers of the Commission,\n\nincluding its contempt powers and authority to revoke a\n\ntelecommunications service provider's certificate of convenience and\n\nnecessity, the Commission may bring an action on behalf of the OLF\n\nor the OUSF, in a court of competent jurisdiction that the\n\nCommission deems appropriate, to recover any unpaid fees and\n\nassessments the Commission has determined are due and payable,\n\nincluding interest, administrative and adjudicative costs, and\n\nattorney fees. Upon collection of the assessments, fees and costs,\n\nthe Administrator shall pay the costs of the actions and deposit the\n\nremaining funds in the OLF or the OUSF as appropriate.\n\nD. The monies deposited in the OLF, the OUSF and the Oklahoma\n\nHigh Cost Fund shall at no time become monies of the state and shall\n\nnot become part of the general budget of the Corporation Commission\n\nor any other state agency. Except as otherwise authorized by the\n\nOklahoma Telecommunications Act of 1997, no monies from the OLF, the\n\nOUSF, or the Oklahoma High Cost Fund shall be transferred for any\n\npurpose to any other state agency or any account of the Corporation\n\nCommission or be used for the purpose of contracting with any other\n\nstate agency or reimbursing any other state agency for any expense.\n\nPayments from the OLF, the OUSF, and the Oklahoma High Cost Fund\n\nshall not become or be construed to be an obligation of this state.\n\nNo claims for reimbursement from the OLF, the OUSF or the Oklahoma\n\nHigh Cost Fund shall be paid with state monies.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"1bb6072826d8742f3f65356cdae39f53565756635323186977f2e69b0837a8bf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-139.106","next":"us-ok/okla.-stat.-tit.-17-17-139.108"},"notice":"GroundRules: Original legal text.
