Stat. tit. 17, § 17-139.303","heading":"Legislative findings — Permissible use","body":"The Oklahoma Legislature finds that Electric Providers, their\n\nbroadband subsidiaries, Telecommunications Providers and Approved\n\nBroadband Providers shall be permitted to use existing electric\n\nutility easements owned, held or otherwise used by that Electric\n\nProvider to provide or expand access to Broadband Services. The\n\ninstallation and operation of Broadband Services within the existing\n\nelectric utility easements are merely changes in the manner or\n\ndegree of the granted use as appropriate to accommodate a new\n\ntechnology and, absent any applicable express prohibition contained\n\nin the instrument conveying or granting such easements, shall be\n\ndeemed as a matter of law to be a permitted use within the scope of\n\nevery Electric Provider's existing electric utility easement.\n\nSubject to compliance with any express prohibitions in an Electric\n\nProvider's easement, and in compliance with this act, the Electric\n\nProvider, its broadband subsidiary, Telecommunications Provider and\n\nan Approved Broadband Provider may use an existing electric utility\n\neasement to install, maintain, lease and operate Broadband Services.\n\nAn Approved Broadband Provider, an Electric Provider's broadband\n\nsubsidiary, or Telecommunications Provider shall attempt to provide\n\nnotice to the property owner.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6a49f48af20c025eb97c7451676ed5e955c71808f9d3a39b35236af31e7175c8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-139.302","next":"us-ok/okla.-stat.-tit.-17-17-139.601"},"notice":"GroundRules: Original legal text.
