Stat. tit. 17, § 17-151.1","heading":"Resale of water or sewage service – Maximum charges –","body":"Disclosure – Penalties - Enforcement.\n\nA. Except for any person, public utility, or public service\n\ncorporation subject to the jurisdiction of the Corporation\n\nCommission, or a municipal utility, or a public trust which has as\n\nits beneficiary the municipality, no owner of any interest in real\n\nproperty in this state who purchases water or sewage services from a\n\nmunicipality and who resells such water or sewage services to any\n\nresidential lessee of any interest in such real property for the\n\npurpose of providing water or sewage services shall charge such\n\nlessee any amount in excess of ten percent (10%) of the cost to such\n\nreseller for each billing cycle of the water or sewage services\n\npurchased by the reseller from the supplier.\n\nB. The reseller shall separately disclose in its water or\n\nsewage services bills to the lessee the per unit cost of its\n\npurchased water or sewage services and the actual amount of each fee\n\nor charge in dollars and cents to be paid by the lessee to the\n\nreseller.\n\nC. Any person who willfully violates the provisions of this\n\nsection, upon conviction thereof by a district court, shall be\n\nguilty of a misdemeanor. In addition to the punishment prescribed\n\nby this subsection, the reseller is liable in treble damages to the\n\nlessee injured, said damages to be recovered in a civil action by\n\nthe consumer so injured. Treble damages shall be based on the total\n\namount to be paid to the reseller by the lessee for each bill which\n\nexceeds the authorized percentage pursuant to this section.\n\nD.
