As used in this section:\n\n1. \"Distributed generation\" means:\n\na. a device that provides electric energy that is owned,\n\noperated, leased or otherwise utilized by the\n\ncustomer,\n\nb. is interconnected to and operates in parallel with the\n\nretail electric supplier's grid and is in compliance\n\nwith the standards established by the retail electric\n\nsupplier,\n\nc. is intended to offset only the energy that would have\n\notherwise been provided by the retail electric\n\nsupplier to the customer during the monthly billing\n\nperiod,\n\nd. does not include generators used exclusively for\n\nemergency purposes,\n\ne. does not include generators operated and controlled by\n\na retail electric supplier, and\n\nf. does not include customers who receive electric\n\nservice which includes a demand-based charge.\n\n2. \"Fixed charge\" means any fixed monthly charge, basic\n\nservice, or other charge not based on the volume of energy consumed\n\nby the customer, which reflects the actual fixed costs of the retail\n\nelectric supplier.\n\n3. “Retail electric supplier” means an entity engaged in the\n\nfurnishing of retail electric service within the State of Oklahoma\n\nand is rate regulated by the Oklahoma Corporation Commission.\n\nB. No retail electric supplier shall increase rates charged or\n\nenforce a surcharge above that required to recover the full costs\n\nnecessary to serve customers who install distributed generation on\n\nthe customer side of the meter after the effective date of this act.\n\nC. No retail electric supplier shall allow customers with\n\ndistributed generation installed after the effective date of this\n\nact to be subsidized by customers in the same class of service who\n\ndo not have distributed generation.\n\nD. A higher fixed charge for customers within the same class of\n\nservice that have distributed generation installed after the\n\neffective date of this act, as compared to the fixed charges of\n\nthose customers who do not have distributed generation, is a means\n\nto avoid subsidization between customers within that class of\n\nservice and shall be deemed in the public interest.\n\nE.
