Stat. tit. 17, § 17-158.24","heading":"Fixing boundaries of certified territories - Protests -","body":"Hearings by Commission.\n\nA. Except as otherwise provided, no retail electric supplier\n\nshall furnish retail electric service in the certified territory of\n\nanother retail electric supplier.\n\nB. Except as otherwise provided in this section, the boundaries\n\nof the certified territory of each retail electric supplier are\n\nhereby set as a line or lines substantially equidistant between its\n\nexisting distribution lines and the nearest existing distribution\n\nlines of any other retail electric supplier in every direction, with\n\nthe result that there is hereby certified to each retail electric\n\nsupplier such unincorporated area which in its entirety is located\n\nsubstantially in closer proximity to one of its existing\n\ndistribution lines than to the nearest existing distribution line of\n\nany other retail electric supplier.\n\nC. (1) On or before ninety (90) days after the effective date\n\nof this act, or, when requested in writing by a retail electric\n\nsupplier and for good cause shown, such further time as the\n\nCommission may fix by order, each retail electric supplier shall\n\nfile with the Commission a map or maps showing all of its existing\n\ndistribution lines. The Commission shall prepare or cause to be\n\nprepared within ninety (90) days thereafter a map or maps of uniform\n\nscale to show, accurately and clearly, the boundaries of the\n\ncertified territory of each retail electric supplier as established\n\nunder Section 4 B, and shall issue such map or maps of certified\n\nterritory to each retail electric supplier. Any retail electric\n\nsupplier or municipality or beneficial trust thereof engaged in the\n\nfurnishing of electric service who feels itself aggrieved by reason\n\nof a certification of territory pursuant to this section may protest\n\nthe certification of territory, not to exceed one township in a\n\nsingle protest, within a one hundred twenty-day period after\n\nissuance of the map of certified territory by the Commission; and\n\nthe Commission shall have the power, after hearing, to revise or\n\nvacate such certified territories or portions thereof.\n\n(2) In such hearing, the Commission shall be guided by the\n\nfollowing conditions as they existed on the effective date of this\n\nact:\n\n(a) The proximity of existing distribution lines to\n\nsuch certified territory.\n\n(b) Which supplier was first furnishing retail\n\nelectric service, and the age of existing facilities, in the area.\n\n(c) Which supplier is the predominant retail electric\n\nsupplier in the area.\n\n(d) The adequacy and dependability of existing\n\ndistribution lines and facilities to provide dependable high quality\n\nretail electric service at reasonable costs.\n\n(e) The elimination and prevention of duplication of\n\nelectric lines and facilities supplying such territory.\n\nIn its determination of such protest, the Commission hearing shall\n\nbe de novo; and neither supplier shall bear the burden of proof.\n\nD. In each unincorporated area, where the Commission shall\n\ndetermine that the existing distribution lines of two or more retail\n\nelectric suppliers are so intertwined or located that Section 4 B\n\ncannot reasonably be applied, the Commission shall, after hearing,\n\ncertify the service territory or territories for the retail electric\n\nsuppliers under the provisions of Section 4 C (2) hereof.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ee69141103d89781537e290a12b5d835e5614d1a2e8f8a8d3763147b6a2d6adf","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-158.23","next":"us-ok/okla.-stat.-tit.-17-17-158.25"},"notice":"GroundRules: Original legal text.
