Stat. tit. 17, § 17-158.55","heading":"Domestic public utility - Filing application for","body":"approval - Exemption.\n\nIf the acquiring party is a domestic public utility, and the\n\nrural electric cooperative, control of which is sought to be\n\nacquired in a transaction described in Section 2 of this act which\n\nwould require the filing of a statement pursuant to Section 2 of\n\nthis act, is subject to the jurisdiction of the Commission, an\n\napplication for approval containing such information as the\n\nCommission may prescribe by rule or regulation adopted pursuant to\n\nthis act, shall be filed with and heard by the Commission after such\n\nnotice as the Commission may prescribe, and the transaction approved\n\nor disapproved based upon the factors enumerated in paragraphs 1\n\nthrough 5 of subsection A of Section 4 of this act, subject to\n\njudicial review as provided in Section 11 of this act, but the other\n\nprovisions of this act shall not apply to such transaction.
