Stat. tit. 17, § 17-159.17","heading":"Provisions of certificate - Defaults","body":"Each certificate of convenience and necessity issued by the\n\nCommission shall establish time limits within which construction\n\nmust be started but in no case shall this exceed six (6) calendar\n\nmonths. The certificate shall also establish a time limit within\n\nwhich the certificated water transportation line will be made\n\navailable for public service. The certificate shall also provide\n\nfor reports to the Commission at appropriate intervals indicating\n\nthe progress of construction, the percentage of completion of the\n\nmajor phases of the project, changes in the estimated completion\n\ndates, and any other appropriate information which may be required\n\nby the Commission.\n\nIf the Commission shall determine that the certificate holder\n\nappears to be in default as to the time limits set out in the\n\ncertificate, it shall conduct a hearing, after ten (10) days'\n\nnotice, and require the certificate holder to show cause why the\n\ncertificate should not be canceled. If the certificate holder shall\n\nshow that it is in default for good cause, such as unanticipated\n\nengineering difficulty, national emergency making materials\n\nunavailable for construction, or other valid reasons over which the\n\ncertificate holder has no control, the Commission may extend the\n\ntime set out in the certificate or in any previous extension.
