Stat. tit. 17, § 17-159.20","heading":"Petition for service","body":"Upon the petition of any person not served by an existing\n\ntransportation line or by a transportation line for which a\n\ncertificate has been issued, the Commission may cause the same to be\n\nset for hearing and give due and proper notice in writing at least\n\nten (10) days prior to the date of hearing to all persons holding\n\ncertificates nearest to those requesting service and to the\n\nmunicipal officers of all municipalities served or to be served by\n\nsuch water transportation companies, and by publication once a week\n\nfor two (2) consecutive weeks in a newspaper or newspapers of\n\ngeneral circulation in the county or counties in which the line is\n\nproposed to be constructed. If at such hearing the Commission finds\n\nfrom competent evidence that the public convenience and necessity\n\nrequire the furnishing of water transportation service to the\n\npetitioners, it shall have the further power to order and direct the\n\nperson holding a certificate who can most economically extend its\n\nservice so as to furnish efficient water transportation service to\n\nthe petitioners to so extend its line. It shall not make an order\n\nso requiring unless it finds, from substantial evidence, that the\n\nperson so ordered to serve is earning a fair return on the fair\n\nvalue of its water transportation line and the rendition of service\n\nto the petitioners will not prevent the person so ordered to serve\n\nfrom earning a fair return on the fair value of its water\n\ntransportation line.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"b78223a53e02fcc2359433b58c74d167b20060012a662820d706e02215db57f9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-159.19","next":"us-ok/okla.-stat.-tit.-17-17-159.21"},"notice":"GroundRules: Original legal text.
