The Corporation Commission shall have ratemaking authority\n\nand general jurisdiction over all supply systems of natural gas,\n\nsteam heat and steam serving the general public notwithstanding\n\noperation thereof by a trust, authority, cooperative and subsidiary\n\ncreated for the benefit or furtherance of a public function pursuant\n\nto a trust or public trust, unless the said body operating said\n\nsystem has financing or is in the process of financing the\n\nacquisition, improvement or extension of the said system with a loan\n\nfrom the United States of America and is a nonprofit trust.\n\nB. The Corporation Commission shall also have general\n\nsupervision over any person or entity to whom the function of\n\noperating a natural gas, steam heat or steam supply system has been\n\ndelegated by such a trust, authority, cooperative or subsidiary.\n\nProvided nothing herein shall be construed to apply to a public\n\ntrust whose Board of Trustees is composed of elected officials or is\n\nelected by the customers or a majority of which is composed of\n\nmembers selected by the governing bodies of municipalities in which\n\nthe public trust operates, or members which it serves, and which\n\nBoard of Trustees has the authority to establish and regulate its\n\nown rates.\n\nC. The Corporation Commission shall have ratemaking authority\n\nand general jurisdiction over all supply systems of steam and\n\nchilled water serving any portion of any municipality if such system\n\nserves more than fifty (50) off-site commercial customers within\n\nsuch municipality.\n\nD. The Corporation Commission shall have the power to fix and\n\nestablish rates and to prescribe rules, requirements and regulations\n\naffecting their services, operation and the management and conduct\n\nof the business of persons and entities subject to this act, Section\n\n160.1 et seq. of this title, and shall inquire into the management\n\nof the business thereof, and the method in which same is conducted.\n\nIt shall have full visitorial and inquisitorial power to examine\n\nsuch operations, and keep informed as to their general conditions,\n\ntheir capitalization, rates, plants, equipment, apparatus and other\n\nproperty owned, leased, controlled or operated, the value of same,\n\nthe management, conduct, operation, practices and services, not only\n\nwith respect to the adequacy, security and accommodation afforded by\n\ntheir service, but also with respect to their compliance with the\n\nConstitution and laws of this state, and with the orders of the\n\nCommission.\n\nE. The ratemaking authority and general jurisdiction of the\n\nCorporation Commission, created under this act, shall be subject to\n\nthe following exceptions:\n\n1. The Corporation Commission shall not have ratemaking\n\nauthority or general jurisdiction over:\n\na. steam supply systems operated by public trusts which\n\nsupply steam to customers presently served by or\n\nlocated within the mid-America industrial district, or\n\nb. an institution of higher education, or related\n\nentities, now operating such steam and chilled water\n\nfacilities not for profit; and\n\n2. The Commission shall not have authority to:\n\na. compel an electric public utility to make inspections\n\nof consumer-owned facilities, or\n\nb. compel an electric public utility to provide electric\n\nutility service wherein the electric public utility\n\nbelieves such service is likely to endanger the public\n\nhealth and safety or the health and safety of\n\nemployees of the electric public utility.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8a26f9c0a8eea84bb28145987142a768906324083c9940002210c52547999bd8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-16","next":"us-ok/okla.-stat.-tit.-17-17-160.11"},"notice":"GroundRules: Original legal text.
