Oklahoma’s wind energy resources are an important asset for\n\nthe continued economic growth of the state and for the provision of\n\nclean and renewable power to both the people of the state and the\n\nnation as a whole;\n\n2. Promotion of the development of wind energy resources is\n\nimportant to the economic growth of the state;\n\n3. The prudent development of wind energy resources requires\n\naddressing the relationship of the needs of wind energy developers\n\nwith those of the mineral estate owners who have the historical\n\nright to make reasonable use of the surface estate, including the\n\nright of ingress and egress therefor, for the purpose of exploring,\n\nsevering, capturing and producing the minerals as reflected in the\n\nExploration Rights Act of 2011, Sections 3 through 7 of this act,\n\nand balancing the needs of wind energy developers with those of the\n\nlandowners who provide access to the wind energy resource, including\n\nassurances that wind turbines and wind energy facilities will be\n\nproperly decommissioned, that they will have access to adequate\n\ninformation to verify the accuracy of their payments, and that they\n\nwill be adequately protected against hazards and accidents that may\n\narise from the wind turbines or wind energy facilities;\n\n4. The conversion of wind energy into power for utility-scale\n\nsystems frequently requires large wind energy systems consisting of\n\nwind turbines, electrical substations, electrical lines, and other\n\nsupporting systems;\n\n5. Wind energy facilities, if abandoned or not properly\n\nmaintained, could pose a hazard to public health, safety, and\n\nwelfare through mechanical failures, electrical hazards, or the\n\nrelease of hazardous substances; and\n\n6. To protect the public against health and safety hazards,\n\nstandards for the safe decommissioning of wind energy facilities\n\nshould be established and assurance of adequate financial resources\n\nshould be given so that the wind energy systems can be properly\n\ndecommissioned at the end of their useful life.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"deada1454a743d99c105d61197f5eb369f5fac1acb531f5acec86331a51f4130","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-160.11","next":"us-ok/okla.-stat.-tit.-17-17-160.13"},"notice":"GroundRules: Original legal text.
