Stat. tit. 17, § 17-160.13","heading":"Definitions","body":"As used in the Oklahoma Wind Energy Development Act:\n\n1. “Abandonment” means the failure to generate electricity from\n\ncommercial wind energy equipment for a period of twenty-four (24)\n\nconsecutive months for reasons other than curtailment, repowering, a\n\nvalid judicial order or other governmental regulatory action, with\n\nno pending negotiations for purchase. A wind energy facility shall\n\nnot be considered abandoned if the owner or operator has elected not\n\nto run the facility, but it has been maintained in proper working\n\norder and is capable of generating electricity;\n\n2. “Commencement of construction” means beginning excavation of\n\nwind turbine foundations or other actions relating to the actual\n\nerection and installation of commercial wind energy equipment. It\n\nshall not include erection of meteorological towers, environmental\n\nassessments, surveys, preliminary engineering or other activities\n\nassociated with assessment of development of the wind resources on a\n\ngiven parcel of property;\n\n3. “Commercial generation date” means the date on which the\n\nwind turbine in question first generates electrical energy in\n\ncommercial quantities;\n\n4. “Commercial wind energy equipment” means a wind tower and\n\nturbine with five hundred kilowatts (500kw) or greater of total\n\nnameplate generating capacity;\n\n5. “Commercial quantities” means an amount of electrical energy\n\nsufficient for sale or use off-site from a wind turbine or wind\n\nenergy facility, and shall not include amounts of electrical energy\n\nused only for the maintenance or testing of the wind turbine or wind\n\nenergy facility itself;\n\n6. “Owner” means the entity having a majority equity interest\n\nin commercial wind energy equipment, including their respective\n\nsuccessors and assigns;\n\n7. “Useful life” means the time during which a wind turbine or\n\nwind energy facility is generating electricity in commercial\n\nquantities;\n\n8. “Wind turbine” means a wind energy conversion system which\n\nconverts wind energy into electricity through the use of a wind\n\nturbine generator and includes the turbine, blade, tower, base and\n\npad transformer, if any; and\n\n9. “Wind energy facility” means an electrical generation\n\nfacility consisting of one or more wind turbines under common\n\nownership or operating control, and includes substations,\n\nmeteorological data towers, aboveground and underground electrical\n\ntransmission lines, transformers, control systems, and other\n\nbuildings or facilities used to support the operation of the\n\nfacility, and whose primary purpose is to supply electricity to an\n\noff-site customer or customers.
