The owner of a wind energy facility shall be responsible, at\n\nits expense, for the proper decommissioning of the facility upon\n\nabandonment or the end of the useful life of the commercial wind\n\nenergy equipment in the wind energy facility.\n\nB. Proper decommissioning of a wind energy facility shall\n\ninclude:\n\n1. Removal of wind turbines, towers, buildings, cabling,\n\nelectrical components, foundations and any other associated\n\nfacilities, to a depth of thirty (30) inches below grade; and\n\n2. Disturbed earth being graded and reseeded or otherwise\n\nrestored to substantially the same physical condition as existed\n\nprior to the construction of the wind energy facility by the owner,\n\nexcluding roads, unless the landowner specifically requests in\n\nwriting that the roads or other land surface areas be restored.\n\nC. The decommissioning of the wind energy facility, or\n\nindividual pieces of commercial wind energy equipment, shall be\n\ncompleted as follows:\n\n1. By the owner of the wind energy facility within twelve (12)\n\nmonths after abandonment or the end of the useful life of the\n\ncommercial wind energy equipment in the wind energy facility; and\n\n2. If the owner of the wind energy facility fails to complete\n\nthe decommissioning within the period prescribed in paragraph 1 of\n\nthis subsection, the Corporation Commission shall take such measures\n\nas are necessary to complete the decommissioning.\n\nD.
