Stat. tit. 17, § 17-160.14A","heading":"Renewable energy recycling facilities — Annual report","body":"— Evidence of financial security.\n\nA. The owner of a renewable energy recycling facility shall\n\nsubmit an annual report to the Public Utility Division of the\n\nCorporation Commission no later than February 1 of each calendar\n\nyear for the immediately preceding calendar year. The report shall\n\ninclude a current total inventory of renewable energy components\n\naccepted for recycling, but not yet recycled, as of the end of the\n\nreporting period and an estimated timeline for the finality of\n\nrecycling of those renewable energy components. The report shall\n\nalso include the estimated costs for completing the recycling of the\n\nreported inventory within the estimated timeline. Provided, the\n\nestimated costs associated with the recycling of wind turbine blades\n\nshall be reported independently from the aggregate cost estimate.\n\nThe report shall be submitted in the manner and form prescribed by\n\nthe Commission.\n\nB. The owner of a renewable energy recycling facility shall\n\nsubmit to the Public Utility Division of the Commission evidence of\n\nfinancial security to cover the anticipated costs of recycling the\n\nreported inventory, including wind turbine blades, during the\n\nupcoming calendar year. Evidence of financial security may be in\n\nthe form of a surety bond, collateral bond, parent guaranty, cash,\n\ncashier’s check, certificate of deposit, bank joint custody receipt,\n\nor other approved negotiable instrument as established in rules\n\npromulgated by the Corporation Commission. Evidence of financial\n\nsecurity shall be submitted within ninety (90) days of the renewable\n\nenergy recycling facility taking control of any renewable energy\n\ncomponents to be recycled.\n\nC. The amount of financial security shall be one hundred\n\ntwenty-five percent (125%) of the estimated total cost of recycling\n\nreported pursuant to subsection A of this section.\n\nD. The Public Utility Division of the Commission shall post on\n\nthe website of the Commission a list of those renewable energy\n\nrecycling facilities that have submitted the report and evidence of\n\nfinancial security in accordance with the provisions of this\n\nsection. An owner of a wind farm operation that chooses to send\n\nwind turbine blade renewable energy components to a third-party\n\nrecycling facility located in this state shall utilize renewable\n\nenergy recycling facilities listed on the Commission website.\n\nE. If the owner of a recycling facility fails to submit the\n\ninformation required by this section, the owner shall be subject to\n\nan administrative penalty not to exceed Five Hundred Dollars\n\n($500.00) per day.\n\nF.
