A retail electric supplier or a subsidiary or affiliate\n\nthereof that provides, owns, operates, or maintains a direct current\n\nfast charging station or hydrogen fueling station directly to the\n\npublic shall do so only through a separate, unregulated entity and\n\nmust do so on the same fees, terms, charges, and conditions offered\n\nto private providers of electric vehicle charging stations.\n\nB. After December 31, 2023, any electric vehicle charging\n\nstation or hydrogen fueling station that is provided by, owned,\n\noperated, or maintained by a retail electric supplier, or a\n\nsubsidiary or affiliate thereof, shall not, directly or indirectly,\n\nbe subsidized by any fee or charge associated with the retail\n\nelectric service provider’s regulated service offerings.\n\nC. An electric vehicle charging provider shall not be\n\nconsidered to be a public utility pursuant to the provisions of\n\nSection 151 of Title 17 of the Oklahoma Statutes or a retail\n\nelectric supplier pursuant to the provisions of the Oklahoma\n\nElectric Vehicle Charging Act or Section 158.22 of Title 17 of the\n\nOklahoma Statutes.\n\nD. Nothing in this section shall be construed to restrict a\n\nretail electric supplier or municipal corporation from subsidizing\n\nthe costs of make-ready infrastructure through fees or charges for\n\nservices provided by its regulated services so long as such subsidy\n\nis offered to electric vehicle charging providers on a\n\nnondiscriminatory basis between such providers.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"72e8a124667c5c9c723ecff3699636adbb2b48de2aca39b7c1331b6bcea93e16","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-160.32","next":"us-ok/okla.-stat.-tit.-17-17-160.34"},"notice":"GroundRules: Original legal text.
