Stat. tit. 17, § 17-161.1","heading":"Restrictions on charges for reselling electric current","body":"or natural gas.\n\nA. Except for any person, public utility, or public service\n\ncorporation subject to the jurisdiction of the Corporation\n\nCommission, or a municipal utility, or a public trust which has as\n\nits beneficiary the municipality, no owner of any interest in real\n\nproperty in this state who purchases electric current or natural gas\n\nfrom a municipality and who resells such electric current or natural\n\ngas to any residential lessee of any interest in such real property\n\nfor the purpose of heat, light or power shall charge such lessee any\n\namount in excess of ten percent (10%) of the cost to such reseller\n\nfor each billing cycle of the electricity or natural gas purchased\n\nby the reseller from the supplier. Provided the provisions of this\n\nsection shall not apply to the resell of electric current or natural\n\ngas pursuant to a commercial lease.\n\nB. The reseller shall separately disclose in its electric or\n\ngas bills to the lessee the per unit cost of its purchased power and\n\nthe actual amount of each fee or charge in dollars and cents to be\n\npaid by the lessee to the reseller.\n\nC. Any person who willfully violates the provisions of this\n\nact, upon conviction by a district court, shall be guilty of a\n\nmisdemeanor. In addition to the punishment prescribed by this\n\nsubsection, said reseller is liable in treble damages to the lessee\n\ninjured, said damages to be recovered in a civil action by the\n\nconsumer so injured. Treble damages shall be based on the total\n\namount to be paid to the reseller by the lessee for each bill which\n\nexceeds the authorized percentage pursuant to this section.\n\nD.
