Advertising expenses shall not be included by a public\n\nutility in its operating expenses for ratemaking purposes.\n\nB. For purposes of subsection A of this section:\n\n1. \"Advertising\" means:\n\na. the commercial use by a public utility of any media\n\nincluding, but not limited to, newspaper, magazine, radio and\n\ntelevision to transmit a message to the public or to such public\n\nutility's customers, or\n\nb. the commercial use by a public utility of any printed\n\nmaterial to transmit a message to a substantial number of members of\n\nthe public or to a substantial number of the public utility's\n\ncustomers;\n\n2. \"Advertising\" shall not mean:\n\na. periodic publications or reports required by the\n\nbylaws of any public utility or electric cooperative, b. any\n\ncommunication with customers and the public which is strictly\n\nlimited to energy conservation and education,\n\nc. any communication with customers and the public which\n\nprovides telephone customers with instruction in the use of new,\n\nchanged or improved features of their telephone service, or\n\ninformation about time periods or other conditions under which long\n\ndistance calls may be made at reduced rates, or information which\n\npromotes the efficient use of the telephone network; provided that\n\nif the cost of providing such information is to be treated as an\n\noperating expense by the public utility, it shall be clearly marked\n\nor identified to indicate the identity of the public utility and the\n\nfact that the cost is paid for by the ratepayers of the public\n\nutility,\n\nd. any communication with customers and the public for\n\ngiving of information or notice required by law or otherwise\n\nnecessary to warn of dangerous or hazardous conditions,\n\ne. routine classified telephone listings for the\n\nconvenience of customers,\n\nf. informational inserts in customers' bills,\n\ng. any communication with customers and the public which\n\ninforms existing and potential customers of the availability and\n\nconservation features of energy-efficient appliances and equipment,\n\nh. any communication with customers and the public which\n\nrelates to industrial development, and\n\ni. any communication with customers and the public which\n\nis in furtherance of conservation or load management programs\n\napproved by the Corporation Commission;\n\n3. \"Public utility\" means any individual, firm, association,\n\npartnership, corporation or any combination thereof, other than a\n\nmunicipal corporation or their lessees, trustees and receivers,\n\nowning or operating for compensation in this state equipment or\n\nfacilities for:\n\na. producing, generating, transmitting, distributing,\n\nselling or furnishing electricity,\n\nb. the conveyance, transmission, reception or\n\ncommunications over a telephone system; provided that no authority\n\nnot otherwise a public utility within the meaning of this section\n\nshall be deemed such solely because of the furnishing or furnishing\n\nand maintenance of a private system, or\n\nc. transmitting directly or indirectly or distributing\n\ncombustible hydrocarbon natural or synthetic natural gas for sale to\n\nthe public; and\n\n4. \"Appliances\" and \"equipment\" mean those individual\n\nappliances and space-conditioning equipment introduced by\n\nmanufacturers after November 9, 1978, which operate at a level of\n\nefficiency at least twenty percent (20%) greater than appliances and\n\nspace-conditioning equipment of the same energy type manufactured\n\nprior to that date.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"e23d46016e8747867677d46765d6327a0d23e0066e5da2ef75210f7a87022612","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-180","next":"us-ok/okla.-stat.-tit.-17-17-180.10"},"notice":"GroundRules: Original legal text.
