No public utility which has for one of its purposes the sale\n\nor distribution of energy may include promotional payments in its\n\noperating expenses for ratemaking purposes.\n\nB. For purposes of subsection A of this section:\n\n1. \"Promotional payment\" means any payment, gift or other\n\nremuneration made directly or indirectly by a public utility to or\n\nfor the account of any builder or other person to encourage or\n\ninduce such builder or other person to install appliances including,\n\nbut not limited to, space heaters, heat pumps, clothes dryers, water\n\nheaters and stoves and equipment which will consume any energy sold\n\nor marketed by such public utility;\n\n2. \"Promotional payment\" shall not mean payments, gifts or\n\nother remuneration made for conservation or load management programs\n\nor energy-efficient appliances and equipment introduction programs\n\napproved by the Corporation Commission;\n\n3. \"Public utility\" means any individual, firm, association,\n\npartnership, corporation, or any combination thereof, other than a\n\nmunicipal corporation, or their lessees, trustees and receivers,\n\nowning or operating for compensation in this state equipment or\n\nfacilities for:\n\na. producing, generating, transmitting, distributing,\n\nselling or furnishing electricity, or\n\nb. transmitting directly or indirectly or distributing\n\ncombustible hydrocarbon natural or synthetic natural gas for sale to\n\nthe public; and\n\n4. \"Appliances\" and \"equipment\" mean those individual\n\nappliances and space-conditioning equipment introduced by\n\nmanufacturers after November 9, 1978, which operate at a level of\n\nefficiency at least twenty percent (20%) greater than appliances and\n\nspace-conditioning equipment of the same energy type manufactured\n\nprior to that date.","path":["OK Code","Title 17"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os17.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5f363b07d1e7f0ae5c6edbc608508ecff7ecee7d33fee85632697ecc53fe76e8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-17-17-180.13","next":"us-ok/okla.-stat.-tit.-17-17-180.4"},"notice":"GroundRules: Original legal text.
